Creator An entity primarily responsible for making the resource د. حسب النبي رحمة د. عثمان خليفة محمد معلم , يوسف Date A point or period of time associated with an event in the lifecycle of the resource 2023-06-01 2021-06-30 Description An account of the resource هدفت هذه الدراسة إلى التعرف على مدى تطبيق المنظمات الصغيرة والمتوسطة للأساليب الكميـة فـي حـل المشكلات و اتخاذ القرار الإدارية بالإضافة للتعرف على مصادر المعرفة بهذه الأساليب وعلى نوعية الأسـاليب التـي تستخدم  فـيها ، وتهدف الدراسة إلى تحديد المعوقات والمشكلات التي تواجه استخدام الأساليب الكمية في اتخاذ القرارات في المنظمات الصغيرة والمتوسطة. حيث استخدمت الدراسة المنهج الوصفي التحليلي،  ويتكـون مجتمع الدراسة من جميع متخي القرار في كافة المستويات التنظيمية والذين يقومون باتخاذ القرار ، حيث بلغ حجم العينة 102 مفردة ، وقد تم الاعتماد على الاستبانة لجمع البيانات، وتم تحليل البيانات للإجابة على أسئلة البحث باستخدام برنامج الحزم الإحصائية SPSS 25 ، واستخدمت الدراسة عدد من الأساليب الإحصائية المناسبة. توصلت الدراسة إلى عدد من النتائج البحثية المهمة منها  أن درجة معرفة المديرين بالأساليب الكمية في المنظمات المبحوثة محل الدراسة ضعيفة أعاق تطبيق هذه الأساليب، و أن مدى استخدام المديرين للأساليب الكمية في اتخاذ القرارات في المنظمات محل الدراسة ضعيف، واقتصار هذا الاستخدام على أساليب بسيطة لا تتطلب معرفة كبيرة . وان أكثر أنواع الأساليب استخداماً من الأساليب الكمية هي: نماذج التنبؤ، والتحليل الإحصائي، ونماذج المخزون. ويعود مصدر هذه المعرفة أساساً إلى الدراسات الجامعية، والممارسة والتطبيق وذلك راجع لكون أغلبية المستجوبين من خريجي كليات الهندسة والاقتصاد والتجارة التي تقدم دروسا في الأساليب الكمية وأن أغلب أفراد العينة يملكون أقدمية في العمل تساوي أو تفوق (16  سنة، كما توصلت الدراسة الى أن أهم مجالات استخدام المديرين للأساليب الكمية تتمثل في: تخصيص الموارد، تقييم الاستثمارات، والتنبؤ بالطلب، وجدولة المشاريع، ومراقبة الجودة، وإدارة المخزون. وهي مجالات مرتبطة إلى حد بعيد بالأساليب المستخدمة المذكورة كما كشفت الدراسة أن أهم المعوقات المتعلقة بمتخذ القرار هي: عدم توافر الأفراد المتخصصين وعدم المعرفة بهذه الأساليب الكمية. .وفي ضوء النتائج التي أسفرت عنها الدراسة، وتأكيدا على أهمية استخدام الأساليب الكمية في اتخاذ القرارات في المنظمات محل الدراسة، قدمت الدراسة مجموعة من التوصيات من أهمها: ضرورة الاهتمام بتعليم الأساليب الكمية في الجامعة، وضرورة ربط الدراسة النظرية بالواقع العملي عن طريق التدريب. وتوفير نظم المعلومات المتكاملة للإدارة البيانات والمعلومات الصحيحة والمناسبة في الوقت المناسب لاتخاذ القرارات، وزيادة أعداد المختصين بالأساليب الكمية وإحداث أقسام أو وحدات إدارية خاصة بهم ، والعمل على تنمية الوعي بأهمية ومزايا استخدام الأساليب الكمية في اتخاذ القرارات. نالت مشكلة تلوث البيئة البحرية بالزيت من اهتمام الدول ما لم تنله مصادر التلوث الأخرى وسبب ذلك هو أن حوالي أكثر من 8 ملايين طن من النفط يتسرب سنويا إلى المحيطات والبحار. كرد فعل على حادث الناقلة 5 ValdezExxon الذي وقع في سنة 1989 والذي ألحق أضرارا جسيمة بالبيئة البحرية لأمريكا الشمالية والثروة السمكية وصناعة الصيد وتحت ضغط الرأي العام الأمريكي، تخلت الولايات المتحدة الأمريكية عن الاتفاقيات الدولية التي كانت تعمل عليها وأصدر الكونغرس الأمريكي تشريعا جديدا شديد القوة، تمثل في قانون التلوث بالزيت في 03 أوت 1990 والمعروف بقانون OPA 1990، وبذلك تكون الولايات المتحدة قد ابتعدت عن النظام الدولي لحماية البيئة البحرية، الإشكالية التي أردت إثارتها في هذا المقال هي ما هي أوجه اللا تماثلية التي تميز التشريع الأمريكي OPA، وهل يمكن اعتبار التشريعات الوطنية بديلا ناجحا عن التشريعات الدولية. The problem of pollution of the marine environment with oil has gained the attention of countries unless other sources of pollution get it. 8 million tons of oil seep annually into the oceans and seas. . In reaction to the 5 Valdez Exxon accident that occurred in 1989, which caused enormous damage to the marine environment in North America, the fisheries and fishing industry. Under the pressure of American public opinion, the United States of America abandoned the international agreements new legislation of great strength. With the issuance of this law, the USA severed the doubt with certainty of its separation from the international system in the field of protecting the marine environment from oil-oil pollution. Especially since this legislation is characterized by accuracy and rigor, which may affect the international legislative system. Therefore, the following question had to be asked: How does the US legislation contribute to O.P.A; in influencing the effectiveness of international agreements in force in the field of protecting the marine environment from pollution resulting from oil and on the rules of international responsibility in this area? The problem that I wanted to raise in this article is what are the asymmetries that characterize the US legislation O.P.A; In terms of effectiveness and its impact on international liability rules. Evaluating  the teaching methodology used in EFL Sudanese classes and discussing factors influencing EFL learners’ performance. The study adapted the descriptive analytical method. The data were collected by means of a questionnaire from  EFL teachers and students. The researcher distributed the questionnaire to 50 of both groups. Then the collected data were analyzed by the SPSS program. The analysis led to the following findings: many  of EFL learners lack of confidence to speak in English, for fear of making mistakes and shy feeling, English language is difficult to learn for many of the Sudanese are not well-motivated, encouraged and to gain strategy, the traditional teaching methodology used in many Sudanese institutions influences  negatively  on EFL learners’ performance, providing EFL learners chances of participatation increases their interaction, adopting suitable teaching methodology  enhances the learning of English language, using real-life interaction like that which improves EFL learners' performance  and using modern technology which improves EFL teaching and learning. The study recommended that: EFL learners should always present with real life interaction, teachers should improve their teaching methodology in EFL classes and learners should be encouraged to make presentations in English language. تهدف هذه الدراسة التحليلية الإستقرائية إلى توضيح توجه المشرع الجزائري نحو دمج الطاقات المتجددة واستثماراتها في البيئة العمرانية الجديدة، وكذا توضيح بصمة هذه العملية على واجهة التنمية العمرانية المستدامة، وذلك من خلال عرض تطبيقات عصرنة العمران الجديد وحماية بيئته بإستخدام الطاقات المتجددة، وتوصلت النتائج الى أن توجه المشرع كان في بدايته قائما على اعتبارات بيئية بحته؛ ليُصبح بعد ذلك تبنيا لأساليب حديثة في عمليات البناء على غرار العمارة الخضراء والمدينة الذكيّة، وما تُحققه من دعم للإستثمار العمراني المستدام، وكذا المقاربة بين جدوته الإقتصادية والبيئيّة. The present analytical inductive study aims at further clarifying the trend of the Algerian legislator towards integrating renewable energies and their investments in the new urban environment, and also to clarifying the Impact of this operation on the interface of sustainable urban development, through providing applications of modernization of the new architecture and the protection of the environment by using renewable energies. The results confined that the target of the project was in its beginning based on mere environmental consideration, to became finaly an adoption of modern ways in the processes of construction similar to the green building and the smart city, and all what is achieved such as the support to the sustainable urban investment, and the approach between its environmental and economic efficiency. When practicing extensive reading, the reader/learner reads a wide variety of text for pleasure and achieves a general understanding of the context while deciphering unknown words through context. This approach contrasts with extensive reading, a more traditional approach based on a slow, careful reading of a text, with goals of complete comprehension and identification of specific details and information. Research supports the use of ER, as it benefits the development of speaking, listening, and writing language skills(Maley 2005), as well as involuntary vocabulary acquisition(Brown, Waring, and Donkaewbua 2008). for this reason, ESL/EFL programs(Day and Bamford 1998). In East Asian nations such as Korea- where EFL increasingly central to education policy- more and more workshops, seminars, and conferences focus on helping teachers incorporate ER programs into their teaching context. There is a wide range of materials available for ER, including graded readers-novels and short stories that are calibrated to the different language levels of learners. However, despite the great support for what has been described as “the single most effective way to improve language proficiency”(Maley 2005,354). “Simply reading” is not a valid use of learning time, nor is it congruent with local expectations of the role of classroom teachers. Traditional basic concepts of state power declined in the age of Siberian power and were replaced by the power of knowledge as the basis of intelligent power. Similarly, the Fourth Generation Revolution has spawned technological innovations, most notably the Blockchain Distributed Block Series System as the latest global digital revolution, and the e-governance approach to understanding the technology and digital revolution. According to that, this study came to understand the role of e-governance as the incubator environment of the blockchain system and its role in reducing corruption between capacity and imperfection, leading to a clear vision of leading international models within three axes. The study found that the distributed mass chain system is a double-edged weapon. On the one hand, it provides transparency, decentralization and reliability, and on the other, it poses a threat to the security of the State through its loss of electronic sovereignty. Creator An entity primarily responsible for making the resource بلال عبدالله أحمد مصلح ويس, طيب إبراهيم Date A point or period of time associated with an event in the lifecycle of the resource 2023-06-01 2021-06-30 Description An account of the resource هدفت هذه الدراسة للتعرف على واقع الرضا الوظيفي لدى العاملين في بلدية غزة، وتكونت عينة الدراسة من 50 موظف وموظفة من بلدية غزة تم اختيارهم بطريقة العينة العشوائية، واستخدمت الدراسة المنهج الوصفي التحليلي. وتوصلت الدراسة إلى أن مستوى الرضا الوظيفي في بلدية غزة جاء بدرجة قليلة، حيث جاء محور ظروف العمل بالترتيب الأول، ثم محور مجموعة العمل بالترتيب الثاني، ثم محور الحوافز والأجور بالترتيب الثالث، في حين جاء محور أسلوب القيادة بالترتيب الرابع، كما توصلت الدراسة إلى عدم وجود فروق في الرضا الوظيفي تعزى لمتغيرات (النوع الاجتماعي، المؤهل العلمي، سنوات الخدمة). وأوصت الدراسة بتعزيز الرضا الوظيفي في بلدية غزة، وذلك من خلال تطوير وتدريب العاملين واكسابهم مهارات جديدة وتنمية قدرات العاملين باستمرار ووضع خطط لتطوير العاملين ومتابعة تنفيذها باستمرار، وزيادة الرضا عن أسلوب ونمط القيادة وذلك من خلال مساعدة الادارة على تطبيق الأساليب الادارية في العمل، ودعم وتوجيه الرؤساء للمرؤوسين. المتمعن في خبايا القانون البحري الجزائري وحتى القوانين المقارنة كالقانون البحري الفرنسي، نجد أن هذه القوانين تضم في طياتها كتابا خاصا متعلق بالأحكام الجزائية الناتجة عن مخالفة أحكام الملاحة البحرية والمينائية، ضف إلى ذلك وجود بالمجال البحري جرائم خاصة لا يمكن لقانون العقوبات كقانون عام على معالجتها وهو الأمر الذي أدركه المشرع الجزائري في تعديل القانون البحري بموجب قانون 98/05 . Creator An entity primarily responsible for making the resource د. دينا إسماعيل محمد أبوزيد بوحلايس, إلهام بن يسعد , عذراء Date A point or period of time associated with an event in the lifecycle of the resource 2023-06-01 2021-06-30 Description An account of the resource إن حداثة نظام الإثبات السعودي بما تضمنه من أحكام مستحدثة يعد دافعًا لمناقشة التعديلات التي طرأت في الشهادة كوسيلة إثبات، وحيث أن نطاق تطبيق هذه الأحكام يمتد إلى جميع النزاعات المدنية والتجارية والعمالية، فكان لزامًا تحليل الأحكام القانونية المتعلقة بالقيود التي وردت على الشهادة في النظام السعودي؛ حيث انتقل النظام من جواز الإثبات بالشهادة إلى الجواز الاستثنائي ثم إلى المنع الكلي للإثبات بالشهادة. تناولت هذه الورقة تحليل هذه الأحكام بتقسيم البحث إلى مبحثين أساسيين. في المبحث الأول، تم التطرق إلى مفهوم الشهادة ومشروعيتها وحجية الشهادة في النظام السعودي، بينما تناول المبحث الثاني القيود الواردة على الشهادة فيتطرق إلى الحالات التي يجوز فيها الإثبات بالشهادة، والحالات التي لا يجوز الإثبات فيها بالشهادة، والحالات الاستثنائية لقبول الشهادة. خلصت هذه الدراسة إلى عدد من التوصيات كضرورة النص على الشروط المتعلقة بأحكام حالات الجواز والمنع والاستثناء كالنص على شروط تطبيق مبدأ الثبوت بالكتابة والموانع الأدبية والمادية والنظر في استبعاد المانع الأدبي من الاستثناءات التي تجيز الإثبات بالشهادة. يعد مبدأ حرية الأسعار من أبجديات الاقتصاد الحر الذي يقوم على المنافسة الاقتصادية، إذ يتيح للمؤسسة وضع السعر الذي يتلاءم مع السلعة أو الخدمة المقدمة، إلا أن ممارسة هذه الحرية يجب ألا تجنح بالمؤسسة إلى استعمال الأسعار سبيلا لإلحاق الضرر بالمنافسة والسوق. وعندما تكون المؤسسة في وضعية هيمنة، فإن خطر المنافسة بالأسعار يزداد، حيث قد تتخذها سبيلا للتعسف عن طريق أوجه متعددة أبرزها الرفع أو الخفض المصطنعين للأسعار. هذا ما أدى بالمشرع الجزائري إلى ضبط هذه الحرية عن طريق حظر التعسف بالأسعار واعتبار التشجيع على ارتفاعها أو انخفاضها اصطناعيا وجها من أوجه التعسف المباشر في الهيمنة، بالإضافة إلى الأوجه الأخرى غير المباشرة. لكن، وفي مواجهته لهذه الممارسة يكون المشرع والهيئات المختصة بين ضرورتين؛ ضرورة التصدي للتعسف من ناحية والحرص على عدم الإخلال بمبدأ الحرية الاقتصادية من ناحية ثانية. فإلى أي مدى وفق المشرع في هذه المعادلة؟ بدراستنا لموضوع التعسف بالأسعار في إطار وضعية الهيمنة وقفنا على أن النصوص المعتمدة للتصدي لهذا التعسف ذات مضمون واسع مرن تضمن تحقيق هذا الغرض، كما أنها تتجاوز قانون المنافسة إلى قانوني الممارسات التجارية والعقوبات، ومع ذلك يبقى تزويد الهيئات المختصة بالضمانات الكافية لمواجهة هذه الممارسات، وكذا التزام المؤسسات بمسؤوليتها الاجتماعية أمران لابد منهما لتحقيق حماية كافية للمنافسة والسوق.
