تناول هذا البحث الشوائب التي دخلت كتب التفسير في القرن الرابع عشر الهجري، حيث بين البحث أولاً أهم الأسباب التي أدت إلى دخول الشوائب في تفاسير هذا القرن مبيناً مناهج أصحابها والأسس التي استندوا عليها في تفاسيرهم وفي إدخال الشوائب في كتب التفسير، كما تناول البحث جملة من الشوائب المنتزعة من كتب التفسير في هذا القرن في جملة من القضايا العقدية والقضايا الاجتماعية والاقتصادية، فبين أصولها وطرق معالجتها ومواردها والرد عليها بالاستشهاد بنصوص الوحي وبالأحاديث النبوية الشريفة إلى جانب مصدر التشريع الأخرى كأقوال الصحابة والتابعين، والإجماع وما سواها من المصادر التشريعية المنبثقة من صميم الشريعة للإسلامية.
وكان من جملة القضايا التي عالجها هذا البحث معاجز الأنبياء عليهم السلام جميعاً والقصص القرآني ومسألة خلق الإنسان، حيث بين البحث كيف حاول أصحاب التفاسير بشوائبهم التقليل من معاجز الأنبياء والتعلق بالماديات عبر تأويلات مفترضة بعيدة عن روح اللغة ولا يحتملها النص القرآني، كما فرغوا القصص القرآني من مضمونها حتى غدت عندهم بمثابة قصص أدبية تتم معالجتها بالطرق الأدبية المعروفة، وهذا ما فيه استهانة بكلام الله جل وعلا ومساواته بكلام المخلوقين، وكذلك تناول البحث جملة من القضايا الاجتماعية والاقتصادية المتصلة بشكل مباشر بحياة الإنسان، كالطلاق وتعدد الزوجات والقمار وما سواها من مسائل نتج عن الشوائب التي أدخلها المفسرون في معالجتهم لها وتفسير الآيات المرتبطة بها تحليل ما حرم الله وتحريم ما حلله متلبسين بلبوس الدعوة إلى الإصلاح والتجديد وكمجاراة أحكام النهضة، فكان هذا كله بالنتيجة بعيداً عن روح الإسلام ومخالفاً لتعاليمه، ومناقضاً لأحكامه ومعارضاً لنصوص الوحي والسنة النبوية الشريفة.
تهدف هذه الدراسة إلى البحث في الأسس النظرية والتطبيقية للميزانية التشاركية وعوامل نجاحها، بوصفها آلية جديدة لتدبير الشأن المحلي في الجزائر، والتي من شأنها تصحيح وضعية سوء إدارة الموارد المالية للجماعات المحلية وفق منهجية التسيير بالأهداف كبداية لإصلاح المالية المحلية .
وتبعا لذلك عزز الدستور الجزائري بعد تعديله سنة 2016، وكذا النصوص القانونية للجماعات المحلية مبدأ الميزانية التشاركية، إلا أن غياب قواعد الممارسة ومتطلبات التجسيد ومعايير التقييم أبقاها حبيسة النصوص، ومع تفاقم الوضع الحالي على المستويين المالي والتنموي وظهور بوادر إنسداد قنوات الإتصال بين السلطة والمجتمع، أصبح تجسيد الميزانية التشاركية أكثر من ضرورة، لبعث العمل التشاركي والرفع من نجاعة الخدمة العمومية فضلا عن تعزيز الثقة بين المواطن والمنتخب تجسيدا للحكامة الرشيدة.
The study aims at examining the theoretical and practical bases of the participatory budget and its success factors.As a new mechanism for local affairs in Algeria, it will correct the poor management concerning the financial resources of local communities.According to the methodology of managing the objectives it is a start to the reform of local finances.
Accordingly, the Algerian constitution as amended in 2016, as well as the legal provisions of the local communities, reinforced the principle of a participatory budget. However, the absence of the rules of practice, the requirements of embodiment and the criteria of evaluation has been kept locked in the texts, with the current situation on the financial and development levels worsening and the signs of a blockage in the channels of communication between the Authority and society emerging ;The embodiment of the participatory budget has become more than necessary, in order to promote participatory action and increase the effectiveness of the public service as well as the strengthening of trust between the citizen and the elected as an embodiment of good governance.

هدفت الدراسة إلى التعرف على أثر استخدام استراتيجية KUD في تنمية التفكير التباعدي في مادة الكيمياء. ولتحقيق أهدافها، تم اعتماد المنهج شبه التجريبي، وقد جرى اختيار العينة بطريقة عشوائية وشملت (69) متعلماً ومتعلمة من متعلمي الصف الخامس العلمي في إعدادية خانكي المختلطة.
تمثلت أدوات الدراسة باختبار للتفكير التباعدي للصف الخامس العلمي، من أجل التعرف على أثر استخدام استراتيجية KUD.
توصلت الدراسة إلى النتائج الآتية:
وجود فروق ذات دلالة إحصائية بين متوسطي درجات متعلمي المجموعة التجريبية بين التطبيقين القبلي والبعدي في اختبار التفكير التباعدي، لصالح التطبيق البعدي.
وجود فروق ذات دلالة إحصائية بين متوسطي درجات طلبة المجموعتين التجريبية والضابطة في التطبيق البعدي المباشر على اختبار التفكير التباعدي، لمصلحة متعلمي المجموعة التجريبية.
عدم وجود فروق ذات دلالة إحصائية بين متوسطي درجات طلبة المجموعة التجريبية على اختبار التفكير التباعدي تبعاً لمتغير الجنس.
وفي ضوء هذه النتائج قدمت الدراسة عدداً من التوصيات والمقترحات.
يترتب على خرق الأنظمة والقوانين التي تتولى إدارة الجمارك تطبيقها مسؤولية جزائية، أما في مواجهة الفاعل سواء كان شخص طبيعي أو معنوي أو شريك على أساس المساهمة، وفقا للقواعد العامة للقانون، كما يتحملها المستفيدون من الغش.
ونظرا لخصوصية الجرائم الجمركية التي تقوم بمجرد الفعل المادي المخالف للقانون، دون البحث عن القصد الجنائي، فإن وقوعها يرتب مسؤولية جزائية من نوع خاص، يتحملها أشخاص لم يتم إثبات المساهمة الشخصية لهم، فيما نسب إليهم من غش من طرف إدارة الجمارك، لمجرد الإحراز المادي للبضاعة محل الغش، وهي قرينة قاطعة، لا يمكن التخلص منها إلا بإثبات القوة القاهرة، بالإضافة إلى المسؤولية القائمة على الخطأ المفترض بالنسبة لأنشطة مهنية معينة، وأكثر من ذلك فإنها تقع على مجرد أعمال تحضيرية لا ترقى إلى مستوى البدء في التنفيذ، حماية للنطاق الجمركي، وهذا وإن كان فيه مساس بقرينة البراءة استثناءا الا انه يتوافق مع الضرورة الحتمية لحماية الاقتصاد.
The violation of the regulations and laws that the Customs Administration undertakes to implement entails a criminal liability, either in confronting the perpetrator, whether he is a natural or legal person or partner, on the basis of the contribution, in accordance with the general rules of the law, as it is borne by the beneficiaries of fraud.
Given the specificity of customs crimes that are merely a material act in violation of the law, without searching for criminal intent, their occurrence entails a special criminal liability, borne by persons who have not been proven. Personal contribution to them, regarding fraud attributed to them by the Customs Administration, for the mere physical seizure of the merchandise subject to fraud, which is a conclusive presumption, which can only be disposed of with proof of force majeure, in addition to the liability based on the presumed error for certain professional activities, and more than that. They are based on mere preparatory work that does not rise to the level of starting implementation, to protect the customs territory, and this is exceptionally infringing on the presumption of innocence, but it corresponds to the imperative need to protect the economy.

إنّ الهدف من الدراسة تسليط الضوء على الدور الذي تقوم به المحاسبة القضائية بغية تحقيق المصداقية بما يخص التقارير المالية ضمن ديوان الرقابة المالية ومكاتب تدقيق الحسابات محل الدراسة.
حيث تم اعتماد المتغير المستقل و هو المحاسبة القضائية و تأثيرها على المتغير التابع و هو المحاسبة الإبداعية .
استندت على منهجين الأول و هو المنهج الوصفي من خلال جمع المعلومات من الكتب والمواقع الالكترونية التي بحثت الموضوع، و المنهج الثاني التحليلي الذي أعتمد على تحليل الاستمارة .
وانتهت الدراسة بخاتمة تتضمّن عرضاً للنتائج ومن أهمها:
أن زيادة مستوى المحاسبة القضائية المعتمد من قبل الأجهزة يمكن ان يساعد في زيادة قدرتها على كشف التلاعبات التي يمكن أن تحدث ضمن قائمة المركز المالي و الاعتماد على المحاسبة القضائية يمكن ان يساعد الأجهزة الرقابية على كشف التلاعبات التي يمكن أن تحدث في قائمة الدخل.
كما أوصت الدراسة بضرورة العمل على تطوير مهارات المحاسبين والمدققين على فهم البيانات المالية والتقارير الصادرة و ضرورة وجود معايير دقيقة ومحددة تلتزم بها الشركات فيما يتعلق بتسعير الموجودات سواء فيما يتعلق بالأسعار الرائجة أو أسعار الصرف.
أدى الحراك الجزائري إلى فتح النقاش مجددا، حول حرية الصحافة باعتبارها واحدة من الحقوق الدستورية والحريات الأساسية، بما تشمله من أوجه عديدة سواء تعلق منها بحق الوصول إلى المعلومة أو حرية تداولها، أو ملكية وسائل الإعلام، غير أن الحديث عن حرية الصحافة في جانبها التشريعي لا يغفل بالضرورة، الحديث عن كفاءة وسائل الإعلام ومؤهلاتها في إدارة الأزمات، ولا يمكن أن يكون الذريعة الأساس وراء واقع الإعلام، لقد تحول الحراك كظاهرة اجتماعية، مع مرور الوقت إلى أزمة في بعض فتراته ألقى المسؤولية على عاتق الإعلام في تنوير الرأي العام وتشكيله، وهذه واحدة من بين أهم أدواره.
تأتي هذه الورقة في محاولة الموازنة بين الجانب التشريعي والفني الإعلامي، في الرؤية إلى واقع التغطية الإعلامية لحراك 22 فيفري، برؤية قانونية واعلامية، معتمدا على المنهج الوصفي والتحليلي، حيث توصلنا إلى أن ضعف المؤسسات وتجاهلها لبعض القوالب الصحفية وظيفتها الوصول إلى الحقيقة، من خلال تتبع كرونولوجيا التغطية الإعلامية ومسؤولية الإعلام في تغطية الأزمات وإدارتها .
The Algerian Mobility has led to the reopening of the debate about freedom of the press as one of the constitutional rights and basic freedoms, including in many aspects, whether related to the right to access information, freedom of circulation, or ownership of the media. However, the discussion about freedom of the press in its legislative aspect is not Necessarily neglects to talk about the efficiency and qualifications of the media in managing crises, and it cannot be the basis behind the reality of the media, the Mobility has turned as a social phenomenon, with the passage of time into a crisis in some of its periods, he placed the responsibility on the media in enlightening public opinion, And his formation, and this is one of his most important roles.
This paper comes in an attempt to balance between the legislative and media technical side, in seeing the reality of the media coverage of the February 22 Mobility with a legal and informational vision, based on the descriptive and analytical approach, as we have concluded that the weakness of institutions and their disregard for some journalistic stereotypes is the task of reaching the truth, from Tracing the chronology of media coverage, and the responsibility of the media in covering and managing crises.

يمكن القول إن البحث حول دور الإعلام الإسلامي المقروء في بناء الفرد والمجتمع يعد موضوعًا مهمًا في ظل التحولات السريعة التي تشهدها المجتمعات الإسلامية والعالمية بشكل عام، والتي تؤثر على القيم والمعتقدات والتصورات الثقافية للأفراد والمجتمعات. ويأتي هذا الاهتمام في سياق تواجه المجتمعات الإسلامية تحديات كبيرة في مختلف المجالات، ومنها التحديات الاقتصادية والسياسية والاجتماعية والثقافية والدينية.
ويعد الإعلام الإسلامي المقروء أحد أهم وسائل التواصل والتوجيه في المجتمعات الإسلامية، حيث يعمل على نشر القيم والمعتقدات الإسلامية وتوجيه الأفراد والمجتمعات نحو السلوك الصحيح والمقبول في الإسلام. ويستخدم الإعلام الإسلامي المقروء مختلف الوسائل والأساليب لتحقيق هذا الدور، مثل صحف ومجلات وكتب ومنشورات إلكترونية ومواقع إلكترونية ومنتديات ومدونات وغيرها.
يتمحور دور الإعلام الإسلامي المقروء في بناء الفرد حول توجيهه وإرشاده دينيًا وترسيخ عقيدته، ونشر الثقافة الإسلامية في الفرد وتعزيز قيمه ومبادئه، ويساعد الإعلام الإسلامي المقروء أيضًا في تحسين مستوى الوعي الديني لدى الفرد وتعزيز التفاعل الإيجابي مع الأحداث الدينية والاجتماعية والثقافية.
أما دور الإعلام الإسلامي المقروء في بناء المجتمع، فيتمثل في نشر الثقافة الإسلامية والأخلاق والقيم في المجتمع وتطويره وازدهاره، ويساعد الإعلام الإسلامي المقروء في تحسين جودة حياة المجتمع وتعزيز التضامن الاجتماعي والاندماج الثقافي.

يتناول البحث أحد المسائل المهمة والحديثة بالميدان الدستوري المرتبطة بمدى قدرة أو تمكين القضاء الدستوري من الرقابة على التعديلات الدستورية في بعض الدساتير المقارنة وموقف الدستور الجزائري من ذلك خاصة في غياب نص دستوري يجيز أو يمنع الرقابة على التعديلات الدستورية، وبيان دور القضاء الدستوري بالرقابة على مدى التزام سلطة التعديل بالقيود المفروضة على التعديل الدستوري، وموقف الفقه والقضاء الدستوريين من إشكالية رقابة القضاء الدستوري على التعديلات الدستورية وأساسها القانوني وموقف المؤسس الدستوري الجزائري من ذلك، وكذا بيان أساليب ونطاق هذه الرقابة وحدودها.ومن نتائج البحث أن الاعتراف باختصاص القضاء الدستوري في الرقابة على التعديلات الدستورية يعد ضمانة حقيقية لحماية نصوص الدستور، وأحد مقومات مبدأ المشروعية وخضوع أعمال السلطات العامة للقانون، وآلية لكفالة الحقوق والحريات الأساسية، حتى في غياب النص الدستوري، على أن وجوده ضروري لحسم مسألة اختلاف الفقه الدستوري بشأن رقابة القضاء الدستوري على التعديلات الدستورية ونطاقها وحدودها.
The subject of the addresses one of the important and modern issues in the constitutional field related to the ability or enabling the constitutional judicature to control constitutional amendments in some comparative constitutions and the position of the Algerian Constitution, especially in the absence of a provision authorizing or prohibiting censorship of constitutional amendments, and the role of the constitutional judicature by monitoring the extent to which the amendment authority complies with the limitations of constitutional amendment, and the position of constitutional jurisprudence and judiciary on the problem of constitutional judicature control over constitutional amendments, their legal basis, the position of the Algerian constitutional institution, the methods and scope of this control and the results of the research: So that Enabling the constitutional judicature to control constitutional amendments is a real guarantee of the protection of the constitution, even in the absence of the text, that its existence is necessary to resolve the problem of constitutional judicature oversight of constitutional amendments, their scope and limits.

هدفت الدراسة الحالية إلى التعرف على واقع عمل فريق متعدد التخصصات مع الطلاب ذوي الإعاقة الفكرية من وجهة نظر معلميهم، وقد استخدم الباحثان المنهج الوصفي التحليلي، حيث تم تصميم استبانة طبقت على عينة مكونة من (84) معلم في إدارة التعليم بمكة المكرمة. وقد أشارت النتائج إلى مستوى متوسط لواقع عمل فريق متعدد التخصصات، كما أشارت النتائج إلى عدم وجود فروق دالة إحصائيا لواقع عمل فريق متعدد التخصصات تعزى للمتغيرات (المؤهل العلمي، التخصص، المرحلة التعليمية) في جميع الأبعاد والدرجة الكلية. وعدم وجود فروق دالة إحصائيا تعزى لمتغير عدد سنوات الخبرة ما عدا بُعد (الخطة التربوية الفردية) ولصالح (5 الى 10 سنوات)، الأنشطة اللاصفية ولصالح (11 سنة فأكثر)، الدرجة الكلية ولصالح (5 الى 10 سنوات). بينما توجد فروق دالة إحصائيا لمتغير الدورات التدريبية وورش العمل في الأبعاد (الخطة التربوية الفردية، البيئة المدرسية، الدرجة الكلية ولصالح (لا يوجد)، والأنشطة اللاصفية ولصالح (1-3).
ترتبط جريمة تبييض الأموال عادة بالبنوك والمؤسسات المالية والمصرفية، فأغلب عمليات التبييض تتم على مستوى البنوك والمؤسسات المالية، وقد ألقى المشرع على عاتق البنوك واجب مكافحة هذه الجريمة باتخاذ تدابير إجرائية ووقائية، في حين ألزمهم بواجب آخر هو السر المصرفي.
The crime of money laundering is usually associated with banks and financial and banking institutions. Most of the whitening operations take place at the level of banks and financial institutions.
The legislator placed on banks the duty to combat this crime by taking procedural and preventive measures, while obliging them with another duty, which is the banking secret.

هدفت هذه الدراسة إلى تعرف درجة توظيف مديري المدارس لمعايير التنمية المهنية وأثرها على اداء المعلمين في تربية السلط، ، بالإضافة لبيان أثر كل من متغيرات المستوى التعليمي، وسنوات الخبرة في التنمية المهنية للمعلمين. إذ تم اختيار عينة الدراسة بالطريقة العشوائية وبلغت (250) معلم ومعلمة. ولتحقيق أهداف الدراسة قامت الباحثة بإعداد استبانة مكونة من(39) فقرة. أظهرت الدراسة أن درجة توظيف مديري المدارس لمعايير التنمية المهنية واثرها على اداء المعلمين في تربية السلط كانت متوسطة. كما أظهرت النتائج عدم وجود فروق ذات دلالة إحصائية تعزى إلى متغير سنوات الخبرة ،والمستوى التعليمي،.كما وأوصت الدراسة بضرورة تعزيز دور المديرين في التنمية المهنية للمعلمين.
المتعلقة بشؤون الأسرة حيث يسلط الضوء على سفر أحد الحاضنين بالمحضون عبر الحدود، إذ يمكن أن يخلف هذا الانتقال غير المشروع أضرارا للمحضون، وبالتالي ظهور عدة إشكالات خاصة على الصعيد العملي، مما دفع بالتشريعات الوطنية والدولية إلى المحاولة لاتخاذ تدابير حمائية من أجل المحافظة على مصلحة المحضون.
فظاهرة النقل غير المشروع للمحضون سيؤثر حتما على وضعية المحضون وخاصة عندما يكون هناك خطف للطفل الذي يكون معرضا للخطر وعرقلة إتصال وزيارة الحاضن أو الحاضنة له، لهذا لابد من مواجهة هذه الظاهرة وإيجاد حلول للحد من إنتشارها.
وقد استدللنا في بحثنا بدراسة هذه الظاهرة من خلال بيان الحماية التي وفرها التشريع للمحضون سواء الوطنية أو الدولية ومعرفة التشريعات الأخرى كالمغربية والتونسية التي ساهمت في الحد من تلك الظاهرة.
This research addresses one of the most important topics related to family affairs, where it highlights the travel of one of the custodians across the border, as this illegal transfer can cause damage to the child and thus the emergence of several problems, especially in the functional feild which have boosted the national and international legislation to try to take protective measures in order to preserve the interest of the child, the phenomenon of illegal transfer of the child will inevitably affect.
His situation, especially when there is a kidnapping of the child and obstruction of communication and visiting of its parent or guardian to him, so it is necessary to face this phenomenon and find solutions to reduce its spread.
We inferred in our research by studying this phenomenon through the statement of protection provided by legislation for the child, whether its national or international besides the knowledge of others legislation, such as Moroccan and Tunisian legislations, that has contributed reducing this phenomenon.

هذه الدراسة البحثية تهدف إلى استقصاء النشاط العلمي والتطور العمراني في عهد السلطان المملوكي الظاهر بيبرس، الذي حكم بين الأعوام 1260 و1277م. تقوم الدراسة على تحليل ثلاث فرضيات رئيسية: الأولى تناقش الدور البارز الذي لعبه بيبرس في تشجيع العلوم الدينية وإنشاء المدارس والمساجد، بينما تتناول الثانية التطور العلمي الذي شهده عهده، وتركز الثالثة على النمو العمراني الذي شهدته الدولة في ذلك الزمان.
تتبع الدراسة منهجية تاريخية وصفية تحليلية، تقوم بتحليل الظواهر التاريخية واستخلاص النتائج لتعميمها، مع التركيز على الفترة الزمنية ما بين 1260م و1277م والمنطقة المكانية التي شملت مصر وبلاد الشام.
تتوقع الدراسة بعض الصعوبات المتعلقة بتباين المرويات التاريخية والتحدي في الحصول على مصادر دقيقة ووافية. تتألف الرسالة من مقدمة وأربعة فصول رئيسية تتناول حياة السلطان بيبرس وأوضاع الدولة في عهده، بالإضافة إلى التركيز على جهوده العلمية والعمرانية في مصر وبلاد الشام والحجاز.
تهدف الدراسة إلى تقديم نظرة شاملة ومتكاملة على النشاط العلمي والعمراني في عهد السلطان الظاهر بيبرس، مما يسهم في إغناء البحث التاريخي حول هذه الفترة الزمنية الهامة في التاريخ الإسلامي. تتناول الدراسة بشكل متعمق جهود بيبرس في تطوير العلوم النقلية والعقلية، وإنشاء المكتبات، وتوسيع الحلقات العلمية التي جذبت طلبة العلم من مختلف البلدان الإسلامية، مما يبرز الدور الكبير الذي لعبه في تعزيز الحركة العلمية والثقافية في ذلك العصر.
تهدف هذه دراسة إلى تسليط الضوء على التنافس الروسي الأمريكي في سوريا، من حيث تحديد مصالح الطرفين والبحث في الدوافع وراء التدخل فيها.
أدرجت كل من روسيا وأمريكا الأزمة السورية ضمن أجندتها باعتبارها بوابة النفوذ إلى الشرق الأوسط، وقد استغلها الطرفان بالشكل الذي يخدم مصالحهما، فروسيا رأت في الأزمة فرصة سانحة لاستعادة الدور الروسي كفاعل في السياسة الدولية، أما أمريكا فاستغلتها لإحكام سيطرتها الكاملة على منطقة الشرق الأوسط والقضاء على آي منافس محتمل.
وقد تحدّد الدور الروسي والأمريكي إزاء الأزمة السورية من خلال التدخل السياسي والعسكري، بداية من الأطراف التي دعمتها كل جهة، ففي الوقت الذي دعمت روسيا نظام الأسد على حساب المعارضة فعلت أمريكا العكس.
The study aims to shed light on the Russian and the United states competition in Syria in terms of defining the interests of the two parties and examining the motives behind their intervention.
Both Russia and the United states included the Syrian crisis in their agenda since it is a gateway to influence in the Middle East, and both sides used it in a way that serves their interests .Russia saw in the crisis an opportunity to restore the Russian role as an actor in the international politics, while the United states used it to tighten its full control over the Middle East and eliminate any potential competitor.
The Russian and the United states role in the Syrian crisis has been determined through military and political intervention, starting with the parties each side supported, while Russia supported the Assad regime at the expense of the opposition, the United states did the opposite.

الحمد لله حمدًا يليق بجلاله، وعظمة سلطانه، وواسع رحمته، نحمده حمدًا كثيرًا طيّبًا مباركًا فيه، ونستغفره ونتوب إليه، والصّلاة والسّلام على نبيّنا محمد، وعلى آله وصحبه أجمعين، فهو المبعوث رحمةً للعالمين. أما بعد:
فقد شرّفنا الله سبحانه وتعالى ، وهدانا بكتابه العزيز، الذي أنزله على خير البشر، وأفضل الخلق، وسيّد الكونين، وخاتم الأنبياء والمرسلين محمد بن عبد الله عليه أفضل الصّلاة وأتمّ التّسليم.
التّربية في القرآن الكريم، هي تربية ربّانيّة، منهجها من عند الله تعالى، فقد جاء الحثّ عن طريق القرآن الكريم، ونحن البشر علينا التّفكير والتّدبّر، فالمهج الإسلاميّ شاملًا لحياة البشر في دنياه وآخرته، و نظم علاقة الإنسان مع جميع ما في الكون حتّى مع نفسه. واتّسمت التّربية الإسلاميّة بالوضوح في مجالات الحياة كافّة، السّياسيّة، والدّينيّة، والاجتماعيّة، والاقتصاديّة.
إنَّ أهميّة تعلّم القرآن وتعليمه، هي من أشرف المهن؛ ولهذا، نحن ملزمون كمسلمين أن نتعلّم كلّ ما يحتويه، وأن نلتزم بكلّ ما فيه من أوامر ونواهي، فهو الدّستور الأعظم، إذا أردنا أن نعيد أمجادنا وحضارتنا وقوّتنا وهيبتنا، فعلينا أن نربّي جيلًا واعيًا ملتزمًا بتعاليم القرآن، فالتّربية السّليمة على النّهج الصّحيح، هي الوسيلة لتحقيق ذلك.
فالقرآن الكريم هو كلام الله سبحانه وتعالى، مهما أجرينا عليه الدّراسات، وبحثنا فيه، فلن نصل إلى قاع بحره المليء بالجواهر الثّمينة، فالعلم كلّه في محتواه يعجز العقل البشريّ عن تدبّر كلّ ما فيه، فقد احتوى الدّنيا والآخرة، والماضي والحاضر والمستقبل.
إنّ ما يميّز به هذه الأمّة عن سواها، أنّها خير أمّة أخرجت للنّاس، قال سبحانه: (كُنْتُمْ خَيْرَ أُمَّةٍ أُخْرِجَتْ لِلنَّاسِ تَأْمُرُونَ بِالْمَعْرُوفِ وَتَنْهَوْنَ عَنِ الْمُنْكَرِ وَتُؤْمِنُونَ بِاللَّهِ وَلَوْ آمَنَ أَهْلُ الْكِتَابِ لَكَانَ خَيْرًا لَهُمْ مِنْهُمُ الْمُؤْمِنُونَ وَأَكْثَرُهُمُ الْفَاسِقُونَ)([1])، كما أنّه بُعث فيها خاتم الأنبياء والمرسلين، وسيّد الثّقلين، محمد r.
وسورة العصر، هي إحدى السّور المكيّة، وعدد آياتها ثلاث آيات فقط، وتوجد في الجزء الثّلاثين من المصحف، وفيها يقول المولى U؛ بعد "بسم الله الرّحمن الرّحيم: (وَالْعَصْرِ (1) إِنَّ الْإِنْسَانَ لَفِي خُسْرٍ (2) إِلَّا الَّذِينَ آمَنُوا وَعَمِلُوا الصَّالِحَاتِ وَتَوَاصَوْا بِالْحَقِّ وَتَوَاصَوْا بِالصَّبْرِ (3))([2]).
وفي هذه السّورة القصيرة، تكمن الكثير الكثير من المعاني التي تبرز منهج متكامل للحياة البشريّة، فيما فيها من مضامين تربويّة وأخلاقيّة، فهي تعلّم الإنسان أنّ النّجاة من النّار بالإيمان، وهي منهج متكامل من التّربية على النّهج السّليم، فقد قال فيها الإمام الشّافعي: "لو ما أنزل الله تعالى حجّة على خلقه إلّا هذه السّورة لكفتهم"، لما لها من فضلٍ، وما احتوت من علمٍ، على الرّغم من صغرها، فقد احتوت على معانٍ كثيرة من قيم ومبادئ وأهداف تدخل بحياة الإنسان من جميع النّواحي، ممّا يدفع فضول طلبة العلم البحث في ما تضمّنته هذه السّورة لمعرفة ما فيها من علمٍ، ومدى تأثيرها على المجتمع الإسلاميّ، ودراسة ما تضمّنته من مضامين تساهم بالنّهوض بالواقع التّربويّ.

تعتبر عقود الإستثمار الدولي، من أهم العقود في المجال الاقتصادي لما تحققه من تنمية على اقتصاديات الدول المتعاقدة في ظلّها، هذا من الجانب العملي، أما من الجانب العلمي فتعدّ مجالاً خصباً للتعمق في دراستها، من قبل الباحثين سواء الاقتصاديين أو القانونيين.
وبالرغم من هذه الأهمية التي تتسّم بها، إلا أنّ الوقوف على الطبيعة القانونية لها يثير جدلاً فقهياً واسعاً، ومن ثم تم بيان ماهيتها وعلى أي أساس مُنحت الطابع الدولي، وتم تناول وصف هذه العقود، بإدراج التعريفات الفقهية وتعريفات القانون الدولي لها وحتى من الجانب القضائي، للوصول إلى تحديد الإطار المفاهيمي لها.
ويقتضي التكييف القانوني لهذا النوع من العقود، التطرق إلى الجدل الفقهي المثار حولها في كونها عقود إدارية، أو تجارية أو مدنية أو ذات طبيعة خاصة، ثم إبراز المعيار المطّبق في اصباغها بالطابع الدولي، بدءا بالمعيار الاقتصادي فالقانوني ثم التركيب بينهما في المعيار المزدوج بينهما لنخلص في الأخير حول ترجيح أحدهم.
ولم نغفل التطرق إلى أبرز نماذج لعقود الإستثمار الدولية وهي عقد الأشغال العامة (البوت) وعقد الفرنشايز.
Practically, international investment contracts are considered one of the most important contracts in the economic field due to the development they achieve on the economies of the contracting countries. On the scientific side it is a fertile field for further study by researchers, whether economists or jurists.
Despite its importance, the legal nature of it raises a wide jurisprudential controversy, and then it was clarified what it is and on what basis it was granted the international character, and the description of these contracts was addressed by including the jurisprudential definitions and the definitions of international law for them. Even from the judicial side, to reach a definition of its conceptual framework.
The legal adaptation of this type of contract requires addressing the jurisprudential debate raised about it as administrative, commercial, civil or private contracts, then ighlighting the standard applied in staining them with an international character, starting with the economic and legal standard, then combining them into the double standard between them to conclude In the end it is about preferring someone.
The most prominent models of international investment contracts is not neglected, which are the public works contract (The B.O.T) and the franchise contract.

تعتبر مباحث الأمر والنهي الأصولية من أهم الموضوعات المطروقة في علم أصول الفقه في هذا العصر حيث أُلِّفت فيها رسائل علمية، وبحوث عديدة، شملت جانبيها التأصيلي والتطبيقي، وموضوع هذا البحث يتعلق بالجانب التأصيلي لأهم المباحث الأصولية بين شرح المنهاج للأصفهاني وشرح مختصر الروضة للطوفي في باب الأمر والنهي حيث تناولت محاوره: التعريف بالمؤلفين الطوفي والاصفهاني، وقد قسمت البحث إلى مقدمة اشتملت على أهمية الموضوع وأسباب اختياره وإشكاليته وأهدافه, ثم مبحث تمهيدي تطرقت فيه عن تعريف أصول الفقه ثم حياة المؤلفيّن الطوفي والأصفهاني رحمهما الله تعالى، ثم جاء الفصل الأول متناولاً موضوع الأمر إذ قمت بدراسة مفهوم الأمر وحقيقته عند الطوفي والاصفهاني وبعدها بينت صيغ الأمر ومقتضاه عند الطوفي والاصفهاني، وأخيراً خصصت مبحث لدراسة الأمر بعد الحظر عند الطوفي والاصفهاني.
ثم جاء الفصل الثاني متناولاً النهي إذ قمت بدراسة مفهوم النهي وحقيقته عند الطوفي والاصفهاني وبعدها بينت صيغ النهي ومقتضاه عند الطوفي والاصفهاني.
إن تسيير الإدارة للمسار المهني للموظف سيمنحها تحكما في مواردها البشرية، حيث تباشر إلى فتح ملف شخصي له بعد توظيفه يحتوي على كل الأوراق التي تهم حالته الإدارية، مع مراعات تسجيل وترتيب وترقيم هذه الأوراق بدون انقطاع، كما تعمد الإدارة إلى تزويد الموظف ببطاقة مهنية ذات مواصفات محددة تسهل تحركاته كما ألزم المشرع الإدارة بضرورة إعلام الموظف بجميع القرارت المتعلقة بمساره المهني، سواء عن طريق التبليغ الشخصي أو الاعلان في النشرة الرسمية للمؤسسة. فالإدارة لها سلطة واسعة في تسيير المسار المهني للموظف مع وجود رقابة لمفتشية الوظيفة العامة أو اللجان المتساوية العضاء في بعض المراحل، وبالرغم من أهمية دور الإدارة في هذا المجال، ومع أن المشرع قد ألزمها بذلك، إلا أنها قد تتقاعس عن تبليغ الموظف بجميع القرارات المتعلقة بمساره المهني في آجالها، رغم سعيه للحصول عليها وهو ما سيحرمه من امتيازات وحقوق مرتبطة بالآجال، من أجل ذلك يمكن تفعيل المراسلات الالكترونية لتحقيق مصلحة الإدارة والموظف معا.

يهدف البحث الكشف عن مستوى معرفة متعلمي المرحلة المتوسطة للمفاهيم العلمية ودوره في تنمية المهارات الحياتية في كتب الفيزياء، ولتحقيق هدف البحث تم اعتماد المنهج الوصفي الذي يتم من خلاله الوصل إلى نتائج كمية تقيس مستوى معرفة المتعلمين للمفاهيم العلمية ومدى امتلاكهم للمهارات الحياتية.
جرى اختيار العينة من متعلمي المرحلة المتوسطة في 9 مدارس، حيث توزعت المدارس بالتساوي بين (العاصمة بغداد، منطقة الريف، مدارس المتميزين)، وتم الاختيار العشوائي ل (294) متعلم ومتعلمة ضمن المناطق الثلاث.
قام الباحث بتحليل محتوى مادة الفيزياء للصف الثالث المتوسط لاستخراج المفاهيم العلمية الواردة ضمن هذه المنهاج، ليتمكن من إعداد الاختبار وفق هذه المفاهيم، ثم قام بإعداد اختبار للمفاهيم العلمية تكون من (40) سؤالاً، وقام أيضاً بإعداد مقياس للمهارات الحياتية، تكون من (28) فقرة، وتوزعت هذه المهارات ضمن أربعة مجالات (حل المشكلات، العمل الجماعي، التواصل والاتصال، المشاركة).
بينت نتائج البحث أن درجة معرفة متعلمي المرحلة المتوسطة للمفاهيم العلمية المتوفرة في كتاب الفيزياء جاءت بنسبة متوسطة، كما أن درجة امتلاكهم للمهارات الحياتية كانت أيضاً بدرجة متوسطة.
أكدت النتائج أنه وفقًا للمتغير (الجنس) ، لم تكن متوسط درجات معرفة متعلمي المرحلة المتوسطة بالمفاهيم العلمية مختلفة إحصائيًا بشكل كبير، بينما تبين وجود في متوسطات درجاتهم تبعاً لمتغير (منطقة المدرسة).
وأظهرت النتائج وجود فروق ذات دلالة إحصائية في متوسط إتقان المهارة الحياتية لدى طلاب المرحلة المتوسطة باختلاف متغير (الجنس) لصالح الاناث، بينما بينت عدم وجود فروق ذات دلالة إحصائية في متوسطات درجاتهم للمهارات الحياتية تبعاً لمتغير (منطقة المدرسة).
المعلوم أن مالك براءة الاختراع له الحق في استغلال براءته وذلك في حدود مدة زمنية، هذا الاستغلال ليس مطلقا بل يخضع لقيود قانونية، تفرضها المصلحة العامة أو اعتبارات الأمن القومي، حيث ظهرت فكرة الترخيص الإجباري كآلية قانونية لاستغلال براءة الاختراع حتى ولو كان صاحبها غير موافق، إذ تم اعتماد هذا النظام لأول مرة وفقا لتعديل اتفاقية باريس للملكية الصناعية 1883 وذلك في لاهاي سنة 1925 كجزاء مطبق على صاحب البراءة لإخلاله بالتزام الاستغلال لاسيما إذا كانت البراءة تمس مجال حيوي كالأدوية أو التغذية، وقد نصت عليه عدة اتفاقيات وتشريعات وطنية على غرار اتفاقية التريبس 1994، كما عالجه المشرع الجزائري في الأمر 03/07 المتعلق ببراءة الاختراع.
