ان هذه الدراسة تهدف لمعرفة فعالية العمل الجماعي، لتنمية مهارات التفكير الإبداعي في مادة الفيزياء، عند متعلمي الصف الثالث متوسط، وقد تم اختيار الاسلوب التحليلي الوصفي، حيث تكون مجتمع الدّراسة من عَشْرِ مدارسَ متوسطة، تتبع مديرية تربية كركوك في العراق، وتم توزيع الاستبانة عليهم في النصف الثاني من العام الدراسي (2023)، وجرى إعداد استبيان للقيام بجمع المعلومات، وشمل مجالَين اثنَين: الأول، تناول فعالية العمل الجماعي، وقد تكوَّن من تسعِ فقرات.
والثاني، تناول مهارات التفكير الإبداعي، والذي تكوَّن من خمسٍ وعشرين فَقرة، حيث تحقق الصدق والثبات لهُ، وجرى على عينة تم اختيارها عن طريق العينة العشوائية، حيث تألفت من مئةَ طالب وطالبة، من طلاب المدارس المتوسطة التي تتبع لمديرية تربية كركوك. وقد توصلت النتائج إلى وجود علاقة ارتباط معنوية، بين فعالية العمل الجماعي، وتنمية مهارات التفكير الإبداعي، وإنَّ كلَّ الأبعاد التابعة لفعالية العمل الجماعي، لها دور بتنمية مهارات التفكير الإبداعية.
يعد التأهيل البيئي مقاربة تتبع من طرف المؤسسات الاقتصادية في مجال حماية البيئة، تعمل على ترقية أدائها البيئي في محيط تنافسي يعتمد على إدراج الاعتبارات البيئية ضمن الممارسات الاقتصادية.
ولتأكيد ذلك، تهدف هذه الورقة البحثية إلى إبراز أهمية التأهيل البيئي في أعمال ونشاطات المؤسسات الإقتصادية قصد الحد من المشكلات البيئية الراهنة، وفق المواصفات البيئية العالمية، وذلك بانتهاج المنهج الوصفي والتحليلي، لتوخي واستقصاء الهدف الأساسي من التأهيل البيئي المتمثل أساسا في حفظ الموارد الطبيعية وترشيد استهلاكها وبالتالي حماية البيئة.
Environmental upgrading is an approach pursued by economic enterprises in the field of environmental protection, in order to upgrade their environmental performance in a competitive environment that depends on including environmental considerations within economic practices.
This research paper aims to highlight the importance of environmental upgrading in economic enterprises’ works and activities in order to reduce the current environmental problems, according to global environmental standards, by adopting a descriptive and analytical approach, as the primary goal of environmental upgrading is to conserve natural resources and rationalize their consumption, and thus protect the environment

هدفت الدراسة إلى التعرف على فاعلية استخدام استراتيجية شبكة النقاش فـي تحصـيل مـادة التـاريخ وتفعيل مهارة التواصل لدى تلميذات الصف الخامس الابتدائي، واقتراح طرائق حديثة وشفافة تحفز الدافعية للتلميذات، كذلك طرح مقترح لأستاذه المادة لتقويم واستثمار المهارات.
كما تم استخدام المنهج التجريبي في تطبيق استراتيجية أسلوب النقاش. حيث تم اختيار مجموعتين، واحدة تجريبية والأخرى ضابطة. وتم تطبيق استراتيجية أسلوب النقاش على (المجموعة التجريبية) لقياس مستوى التحصيل ومهارة التواصل فيما بعد. تكَوَنَ مجتمع البحث من مدرسة الألباب الابتدائية في محافظة واسط قضاء العزيزية. تألفتعيّنة البحث من تلميذات الصف الخامس الابتدائي، وبلغ العدد (60) تلميذة وتم تطبيق اختبار تحصيلي بعدي في استراتيجية شبكة النقاش مع المجموعة التجريبية، دلّت نتائج الدراسة على:
أن لاستخدام إستراتيجية شبكة النقاش أثر في زيادة التحصيل لتلميذات الصف الخامس الابتدائي في مادة التاريخ.
أن لاستخدام إستراتيجية شبكة النقاش تأثير في تفعيل مهارة التواصل لدى التلميذات في الصف الخامس الابتدائي في مادة التاريخ.
توجد فروق ذات دلالة إحصائية بين متوسط درجات تلميذات الخامس ابتدائي في المجموعة التجريبية اللاتي تعلمن مادة التاريخ ,وفقاً لإستراتيجية شبكة النقاش ومتوسط درجات تلميذات الخامس ابتدائي في المجموعة الضابطة اللاتي تعلمن المادة وفق الطريقة الاعتيادية.
تهدف هذه الدراسة إلى تبيان دور الاتحاد الإفريقي في التصدي للتغييرات غير الدستورية بالقارة، باعتبارها الوسيلة الأكثر شيوعاً لانتقال السلطة في القارة الإفريقية، ولئن أثبتت منظمة الوحدة الإفريقية سابقاً فشلها في التعامل مع التغييرات غير الدستورية التي كانت تحدث في القارة الإفريقية، إلا أنه ومع تأسيس الاتحاد الإفريقي سارع هذا الأخير إلى تبني العديد من الصكوك القانونية التي تهدف إلى حظر ومنع الوصول إلى السلطة بطريقة غير شرعية ودستورية، كان أهمها على الإطلاق تبنيه للميثاق الإفريقي للديمقراطية، الانتخابات والحكامة في جانفي 2007.
وقد انتهت الدراسة إلى تقديم بعض الاقتراحات من أجل تحسين رد فعل الاتحاد الإفريقي في مواجهة ظاهرة تغيير الحكومات بطريقة غير شرعية ودستورية بالقارة الإفريقية.
This study aims to demonstrate the role of the African Union in confronting unconstitutional changes in the continent, as it is the most common means of transferring power on the African continent, and while the Organization of African Unity previously proved its failure to deal with the unconstitutional changes that were taking place on the African continent, but with the establishment of the Union The latter was quick to adopt several legal instruments aimed at prohibiting and preventing access to power in an illegal and constitutional manner, the most important of which was the adoption by the Union of the African Charter for Democracy, Elections and Governance in January 2007.
The study concluded by presenting some suggestions to improve the reaction of the African Union in confronting the phenomenon of illegal and constitutional change of government in the African continent.

استهدف هذا البحث بيان بعض البنى والصيغ الصرفية، ومدى ارتباط معانيها المتنوعة بمادة الكلمة وبنائها الصرفي؛ والكشف عن مدي اعتماد الراضي باللّه على تنوع البناء الصرفي للكلمة واشتقاقاتها في تعميق المعنى المراد وتوصيله؛ إذ إن اختلاف البناء الصرفي للكلمة هو ما يكسبها معناها وثراءها، وقد توصل البحث إلى عدة نتائج حول طبيعة الأبنية الصرفية في شعر الراضي باللّه، والتي استعرض الباحث بعضًا من تلك الأبنية المتنوعة والعديدة في ديوان الراضي مما يدل على غزارة علمه بالصرف وأبنيته، وفاعلية البناء الصرفي للكلمة في توصيل مقاصد الشاعر، وتكثيفها بدقة من خلال أكثر البنى الصرفية استعمالًا في ديوانه.
تهدف هذه الورقة البحثية إلى دراسة جريمة القذف التي تعتبر من الجرائم التي تنال من شرف واعتبار الأشخاص. خاصة مع تزايد دعاوى المسؤولية المتعلقة بها بشكل ملحوظ في السنوات الأخيرة.
وتوصلنا في هذه البحث إلى وجود جهود كبيرة من طرف المشرع الجزائري في ظل التعديل الأخير لقانون الإعلام لأجل التصدي لهذه الجريمة، من خلال تشديد العقوبات الواردة عليها.
ولاحظنا أيضا وجود العديد من النقائص والتناقضات، وغياب تنسيق فيما بين قانون العقوبات وقانون الإعلام، سنقوم بالتطرق إليها في متن البحث.
This paper aims to study the crime of defamation, which is considered to be crimes against honor and consideration of the persons being. In particular, with claims of responsibility having increased significantly in recent years .
In this research, we have found that there are considerable efforts by the Algerian legislature under the recent amendment of the Information Act to deal with this crime, through the tightening of the penalties.We have also noted that there are many shortcomings and contradictions, and that there is no coordination between the Penal Code and the Media Act, which we will look at in the search.

الغرض من الدراسة معرفة مستوى مهارات التواصل الرياضياتي ومستوى الدافعية للإنجاز عند طلبة المرحلة الثانية المتوسطة. ومعرفة العلاقة بين مهارات التواصل الرياضياتي والدافعية للانجاز ، والتعرف على الفروق في مستوى متوسط مهارات التواصل الرياضياتي والفروق في مستوى دافعية الانجاز لدى العينة وفق متغير الجنس.
واعتمد منهج البحث الوصفي الارتباطي، وأعد اختبار مهارات التواصل الرياضياتي مكون من ثلاث مهارات وتكون الاختبار من (18) فقرة والمقياس (الاستبيان) لقياس دافع الانجاز لمادة الرياضيات تكون من(30) فقرة. وتم التحقيق من صدق وثبات للاختبار والاستبيان.
واعتُمد البرنامج الاحصائي(SPSS) لإيجاد النتائج الاتيه:
مستوى تمكن طلبة المرحلة الثانية المتوسطة من مهارات التواصل الرياضياتي, وجد بمستوى متوسط
مستوى تمكن طلبة المرحلة الثانية المتوسطة في مقياس دافعية الانجاز و جاء بدرجة مرتفعة.
تقدم الطالبات على الطلاب في مهارات التواصل الرياضي.
تقدم الطالبات على الطلاب في دافعية الانجاز في الرياضيات.
هناك ارتباط مرتفع في العلاقه بين مهارات التواصل الرياضياتي ومقياس دافعية الانجاز.
من خلال نتائج الدراسة يوصي الباحث بالاتي:-
حث خُبراء و واضعي منهاج مادة الرياضيات على توافر الفرص العلمية التي تساهم على نمو مهارات التواصل الرياضياتي لدى المتعلمين
اقامة دورات تؤهل كوادر المعلمين والمعلمات لمادة الرياضيات على الكيفية التي تنمى بها مهارات التواصل الرياضياتي من اجل رفع مستويات التحصيل لدى المتعلمين .
تضمين كتاب المعلم للمرحلة المتوسط لاستراتيجيات حديثة عند تدريسهم الرياضيات من شأنها رفع مهارات التواصل الرياضياتي وتنمية دافعية الانجاز لديهم.
اعتماد طرق تدريس حديثه تعتمد على المشاركه الفاعله للمتعلمين ورفع مستوى تفكيرهم. بعيدا عن الطرق القديمه المعتمده على اسلوب التلقين والحفظ .
الحث على اعداد كراس خاص للطلاب يتضمن اختبارات مهارات التواصل الرياضياتي من قبل واضعي المناهج وشرحا عن كيفية اعدادها واعتِمادها
تعتبر الطاقة الأحفورية بتنوع مصادرها من أهم القطاعات الحيوية التي تساهم في نهضة الأمم، ومن المؤشرات المعتمدة لقياس مدى قوة النمو الاقتصادي للدول؛ إذ تتنافس على ملكية موارد الطاقات الأحفورية، وقد تدخل في الحروب والصراعات من أجل الاستحواذ على مناطق النفط لما له من دور إستراتيجي في رفع معدل النمو الاقتصادي للبلدان.
يناقش هذا المقال العلاقة بين حوكمة الطاقات الأحفورية ومواجهة تغيّر المناخ، إذ أن أزمة الطاقة العالمية مقترنة بتهديد تغيّر المناخ العالمي، وذلك من خلال الكفاءة في ترشيد استخدام الوقود الأحفوري، والتحوّل من الطاقات الأحفورية إلى الطاقات المتجددة كبديل ناجع، قصد الحصول على طاقة نظيفة خالية من الكربون، وضمن هذا الإطار تدور الكثير من المناقشات الدائرة اليوم حول التغيّر المناخي والحاجة إلى التقليل من انبعاث الكربون، لكن الفترة الزمنية اللازمة لمعالجة القضايا المتعلقة بالتغيّر المناخي طويلة جدا، خاصة مع تزايد الطلب العالمي على الطاقة الأحفورية، وخلصت الدراسة إلى أنه من أجل ضمان مستقبل صحّي ومستدام، يجب الاعتماد على موارد طاقوية قليلة التكاليف ومستدامة، ومراعية للجوانب البيئية، من أجل تحقيق الاستدامة البيئية.

كان الهدف من الدراسة معرفة : مدى توجيه الاشراف الاختصاصي لمادة الرياضيات مدرسيهم الى استخدام التقويم الواقعي لطلبتهم، والتعرف على مستوى ممارسة مدرسي ومدرسات الثاني المتوسط لمادة الرياضيات للتقويم الواقعي ومعيقات تطبيقه من وجهة نظرهم. و معرفة الفروق في استجاباتهم للتقويم الواقعي ومعيقات تطبيقه من وجهة نظرهم وفق متغير (الجنس، والخبرة).
اعتمد منهج البحث التحليلي و الوصفي واستخدم استبيانين:الاول: استبيان لقياس واقع تطبيق الاستراتيجيات تكون من(40) فقرة موزعة الى 5 استراتيجيات. والاستبيان الثاني لقياس المعوقات في تطبيق الاستراتيجيات تكون من (21) فقرة موزع الى اربع مجالات وتم الصدق والثبات وطبق على العينة (31) مدرس ومدرسة بواقع (23) مدرس و8 مدرسات، و 6 مشرفين . وتم الاعتماد على الحقيبة الاحصائية (SPSS) وبينت النتائج:
ضعف ممارسة مدرسي ومدرسات الرياضيات التقويم الواقعي على طلبتهم من وجهة نظر مشرفي الاختصاص.
هناك دور ضعيف لمشرفي الاختصاص في توجيه مدرسي ومدرسات الرياضيات نحو تطبيق التقويم الواقعي.
ضعف ممارسة مدرسي ومدرسات الرياضيات التقويم الواقعي على طلبتهم من وجهة نظرهم.
توجد معيقات تحول دون تطبيق مدرسي ومدرسات الرياضيات التقويم الواقعي على طلبتهم من وجهة نظرهم.
إن التوسع الكبير في استخدام التقنيات المعلوماتية كوسيلة للتقدم التكنولوجي في جمع وتخزين ومعالجة المعطيات ذات الطابع الشخصي لأغراض متعددة، أظهر بشكل متسارع الشعور بمخاطر تقنية المعلومات وتهديدها للخصوصية نتيجة الحالات الواقعية للاستخدام غير المشروع للمعطيات الشخصية، لذلك فقد وضعت التشريعات المقارنة مجموعة من الضوابط والضمانات التي تهدف إلى رقابة فعالة على كيفية استخدام المعطيات الشخصية للأفراد الذين تكون معطياتهم الشخصية محل معالجة.
والمشرع الجزائري بعد أن كان قد اعترف بالخصوصية في جانبها المادي، نجده يساير التشريعات الحديثة في الاعتراف بالخصوصية في جانبها المعنوي، من خلال تنظيمه وحمايته للحق في السيطرة على المعطيات الشخصية بالقانون 18/07 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي.
وتتناول هذه الدراسة البحث في نصوص هذا القانون للوقوف على مدى نجاح المشرع في سد الفراغ التشريعي أمام عجز النصوص التقليدية في حماية الخصوصية المعلوماتية.
The great use of information technologies through computers as a means of modern technology in collecting, storing and processing personal data for different purposes, it has rapidly demonstrated a sense of information technology risks and threats to privacy because of the actual cases of illegal use of personal data. The establishment of automated information systems by the state and its agencies and the private sector is not absolute and without control.
Comparative legislations described a set of regulations and guarantees aims an effective control of how personal data is used for individuals whose personal data is being processed.
The Algerian legislator, and after he recognized the privacy in its physical aspect (housing inviolability ...), is going along with modern legislation in recognizing privacy in its moral aspect by regulating and protecting the right to control personal data by law 18/07 related to protecting normal peoplein the field of personal data processing.
This study to examine these law textsto determine to whatextent of it iseffective in filling the legislative gapwhen the traditional texts failed to protect information privacy.

اكتسب المعلم هذه المعرفة من خلال التعلم عن بعد التعليمي في الجامعات أو من خلال الدورات التدريبية على أساس توظيفهم. في العصر الحديث، تطور التعليم بالمعلوماتية إلى تعليم مختلف يركز على المتعلم ويتمحور حوله ويعطيه معلومات ومفهومًا بطريقة أخرى أكثر تشويقًا. يقدم المعلم درسًا بطريقة مباشرة تلهم الطلاب للرغبة في تعلم المزيد. ما يهم هو ما إذا كان المعلم يرسل الدرس عبر البريد الإلكتروني أو يشرح ذلك باستخدام منصة تعليمية إلكترونية داخل الفصل، مما يعزز مشاركة الطلاب وإثارة أكبر، وهذا يستدعي تكثيف جهود الإدارة والمشرفين لمعرفة ما إذا كان يمكن إنشاء هذه المنصات متوفرة في الكليات والجامعات، وكذلك لتشجيع المعلمين على استخدامها ومهاراتهم على هذه المنصات، ويجب استخدام هذه المنصات التعليمية الإلكترونية من قبل وزارة التربية والتعليم في جميع دورات اللغة الإنجليزية وغيرها من الدورات التعليمية الخاصة بالموضوع لأنها تساعد الطلاب التركيز والفهم أكثر، والأهم من ذلك أنها تحسن كفاءة المعلم.
هدفت الدراسة إلى محاولة الإحاطة بأهم الأحكام التي تضمنتها قواعد القانون الدولي الإنساني فيما يتعلق بحظر التعذيب كونه انتهاكا جسيما يستوجب مساءلة مرتكبيه، وتحليل أحكام القانون الدولي الجنائي المعنية بتجريم هذا الفعل من خلال التطرق للأنظمة الأساسية للمحاكم الجنائية الدولية المؤقتة منها والدائمة وكذا في الأحكام والقرارات الصادرة عنها.
من ثمة جاءت إشكالية الدراسة متمحورة حول مدى كفاية الأحكام المتعلقة بجريمة التعذيب في القانون الدولي الإنساني والقانون الدولي الجنائي في ظل تنامي صورها؟
وللإجابة على هذه الإشكالية تم استخدام المنهج الوصفي لتحديد مفهوم هذه الجريمة في القانون الدولي الإنساني وفي القانون الدولي الجنائي، والمنهج التحليلي لتحليل الاجتهادات القضائية الصادرة عن المحاكم الجنائية الدولية ومقارنة مضامنيها.
خلصت الدراسة إلى أنه أمام غياب تعريف لجريمة التعذيب في القانون الدولي الانساني لجأت المحاكم الجنائية الدولية بداية إلى التعريف الذي أوردته اتفاقية الأمم المتحدة لمناهضة التعذيب لعام 1984، ثم انحرفت عن هذا التوجه باعتمادها على قواعد القانون الدولي الإنساني والقانون الدولي الجنائي القائمة على إسقاط الصفة الرسمية للجاني والاعتداد بطبيعة الفعل المرتكب.
The study aimed to attempt to understand the most important provisions contained in the rules of international humanitarian law regarding the prohibition of torture, as it is a grave violation that requires accountability for its perpetrators, and to analyze the provisions of international criminal law concerned with the criminalization of this act by addressing the statutes of the temporary and permanent international criminal courts and as well as the judgments and decisionsissued by it.
From there, the problem of the study revolved around the adequacy of the provisions relating to the crime of torture in international humanitarian law and international criminal law in the light of the growing images.
To answer this problem, the descriptive approachwasused to define the concept of this crime in international humanitarian law and in international criminal law, and the analytical approach to analyze the jurisprudence issued by the international criminal courts and compare its contents.
The study concluded that, in light of the absence of a definition of the crime of torture in international humanitarian law, international criminal courts first resorted to the definition provided by the United Nations Convention Against Torture of 1984 ,then it deviated from this trend by relying on the rules of international humanitarian law and international criminal law based on dropping the official status of the perpetrator and taking into account the nature of the act committed.

استهدفت الدراسة إلى تحديد أثر نموذج أوزبورن في تحسين التفكير والتحصيل الأكاديمي لطلبة الفيزياء الصف الرابع ممثلة في مدرسة نبوخذ نصر الإعدادية للبنين في الكرخ 2 ، بغداد. تم تطبيق النموذج على مجموعتين من الطلاب في فصل العلوم الرابع. اعتمدت هذه الدراسة طريقة تجريبية. كلا المجموعتين تستخدم قبل وبعد الاختبار. بينت النتائج أن معدل متوسط الدرجات التي نالها متعلمي المجموعة التجريبية الذين تعلموا الفيزياء وفقًا لنموذج Osborn-Parnes كان مختلفًا إحصائيًا عن متوسط الدرجات لمتعلمي المجموعة الضابطة الذين تعلموا الشيء نفسه عند مستوى الدلالة (0.05). اختبار التحصيل حسب نموذج Osborn-Parnes فإن متوسط درجات المجموعة التجريبية المتعلمون الذين يتعلمون الفيزياء في التفكير العلمي الأساسي الرابع هو نفس متوسط درجة المجموعة الضابطة لتعلم متعلمي الفيزياء وقد تم تسجيل مستويات الدلالة (0.05) بين نفس المواضيع بالطريقة العادية. كما قدمت الدراسة عدة توصيات.
يُتَرْجِم المرسوم التنفيذي 19-165 المحدد لكيفيات تقييم الموظف تنظيما تشريعيا للتقييم، بهيكلته قانونيا وإجرائيا، وضبط صلته بالمسار المهني، هدفه تثمين مدلول التقييم في مجال الوظيفة العمومية، بالمفاضلة بين نظام تحفيزي وآخر إصلاحي، تقويمي، تكون محصلته استحقاقات مدارها جودة الأداء، غير أنه لا يمكن تحقيق منظور النص للتقييم؛ إلا من خلال إِحْكَامِ ضبطه موضوعيا، بتبني منهج غايته أنمذجة النصوص القانونية، من منظور الأمن القانوني ؛ مع مراعاة جوهر التقييم، في ظل هذه المقاربة ترتكز الدراسة على قراءة تحليلية نقدية للمرسوم التنفيذي 19-165 بالبحث في جودته بمقاربته بالأمن القانوني.
خلصت هذه الدراسة إلى نتائج تتعلق بأهمية الأمن القانوني في التأسيس لجودة المرسوم التنفيذي 19-165، وعليه تبرز ضرورة تعميق الدراسات المرتبطة به، وإعادة قراءة لكيفياته وآثاره على المسار المهني، ما يسهم في تفعيل الضمانات التشريعية للموظف المُقَيَمْ.
The Executive Decree 19-165 specifying the methods for employee evaluation is translated into a legislative organization for evaluation, with its legal and procedural structure, and scheming its association with the professional path. Its goal is to value the significance of evaluation in the field of public employment, by making a comparison between the motivational the reformative systems, the outcome of which is the benefits of performance quality. Nevertheless, the textual perspective of the evaluation can only be achieved through a substantive control, via the adaptation of an approach aimed at legal textual modeling, from a legal security perspective on one hand; and taking into account the essence of the evaluation on the other hand. In light of this approach, the present study focuses on a critical analytical reading of the Executive Decree 19-165 by researching its quality in contrast to Legal security.
Findings of the study revealed the importance of legal security in establishing the quality of Executive Decree 19-165, and therefore it is necessary to deepen the studies associated with it, and re- read its qualifications and effects on the professional path, which contributes therefore to the activation of the legislative guarantees for the resident employee.

أصبح العالم قرية صغيرة كونية في ظل عصر ثورة المعلومات والانفجار المعلوماتي الهائل، وخاصة ظهور شبكات التواصل الاجتماعي دورها الفاعل على مستوي العالم بشكل عام وتجلي بشكل مباشر ما يسمي بالثورات العربية، لذا هدفت هذه الدراسة بشكل أساسي إلى التعرف إلى الدور الذي تقوم به أساليب الاتصال بالجامعات الفلسطينية في تعزيز قيم المواطنة عبر شبكات التواصل الاجتماعي.
وطبقت الدراسة على عينة عشوائية من الطلبة في الجامعات الفلسطينية وهي( جامعة الأزهر، والقدس المفتوحة، والجامعة الإسلامية) من مجتمع الدراسة من الفلسطينية في قطاع غزة، وهم أكثر فئات المجتمع الفلسطيني استخداماً للإنترنت، ومواقع التواصل الاجتماعي، لتحقيق أهداف الدراسة والإجابة عليها.
تتمحور إشكالية هذه المقال في التطرق إلى أهم التهديدات البيئية التي تأثر على الامن البيئي بشكل عام والإنسان بشكل خاص، وهي ظاهرة تغير المناخ وانعكاساتها على تلوث المنابع المائية وتآكل الغابات الطبيعية، وازدياد معدلات حرارة الأرض ومدى تأثير هذه الظاهرة على البيئة، وعلى العلاقة بين تحقيق التنمية الاقتصادية ورفع مستويات المعيشة للإنسان، وبين الحفاظ على التوازن البيئي خاصة في مجال العقود الادارية وبالتحديد عقود الصفقات العمومية، بمعنى آخر كيف يمكن لظاهرة تغير المناخ سواء الطبيعية أو التي يتسبب الإنسان فيها أن تأثر على التوازن الطبيعي ومنه التأثير على التنمية خاصة في مجال عقود الصفقات العمومية؟
This article deals with the most important environmental threats facing the environmental security, and the human being in particular, which is the phenomenon of climate change. This latter has several effects such as pollution of water sources, erosion of natural forests, as well as the increasing in global warming rates and so in General impacts on the environment vival elements. يهدف هذا البحث إلى تسليط الضوء على مكانة القضاة عند الخلفاء العباسيين واسباب امتناع البعض منهم من تولي القضاء، وتُعدُّ هذه الوظيفة من أهم الوظائف في الدولة الاسلامية وكيف تطورت على مر العصور المختلفة وكيف اصبحت هذه الوظيفة مرتبطة بالخليفة نفسه في اختيار قضاته حتى في فترة ضعف الخلافة العباسية، فقد بقيت على نفس الأسلوب في التعيين لكونه من الوظائف الحساسة والمهمة ولقربهم من الخليفة، بحيث كان للقضاة مكانةً كبيرةً لدى الخلفاء العباسيين الذين أولوهم ثقتهم وكلفوهم بشتى الوظائف الإدارية والسياسية إلى جانب الاستشارات السياسية والدينية من خلال حضورهم لمجالس الخلفاء، فضلاً لما يمتلكه بعض القضاة من مواهب علمية وأدبية كانت لهم فيها مصنفات ومؤلفات مهمة. وقد تكون البحث من مبحثين المبحث الاول: مكانة القضاة عند الخلفاء العباسيين والمبحث الثاني: اسباب امتناع القضاة من تولي القضاء وخاتمة والمصادر والمراجع.
قبل الخوض بتفاصيل مكانة القضاة وسبب امتناع بعضهم عن تولي القضاء لابد لنا من تعريف القضاء لغةً واصطلاحاً.
القضاء لغةً: القضاء جاء من مصدر الفعل قضى، يقضي فهو قاضٍ([1]) وقد ورد الفعل قضى بعدة معانٍ منها: الأداء، الإتمام والأمر، إلاّ أنّ المعنى الأكثر استعمالاً يأتي بمعنى الحكم والفصل بين المتنازعين([2]) لقوله تعالى:﴿وَاللَّهُ يَقْضِي بِالْحَقِّ ۖ﴾ ([3])، وقوله:﴿ فَاقْضِ ما أَنْتَ قاضٍ﴾([4]).
أماّ القضاء اصطلاحاً: فقد ورد بمعانٍ عدة منها:
الإلزام أو فصل الخصومات([5])، كما عرفه ابن خلدون بقوله: (( الفصل بين الناس حسماً للتداعي وقطعاً للنزاع بالأدلة الشرعية من الكتاب والسنة ))([6])، أي هو وظيفة اجتماعية عرفتها البشرية منذ العهود القديمة، أملتها عليها حاجة المجتمع في الفصل بأنواع الخصومات([7]).

إن مبدأ السيادة يرتب طبقًا للقانون الدولي للدولة حق إبرام اتفاقيات تتضمن قيودًا على سلطاتها السيادية، وإذا كان إبرام المعاهدات يشكل تقييدًا لممارسة الدولة لحقوقها السيادية فإن أهلية إبرام المعاهدات تعد خاصية من خصائص السيادة، فحق الدولة في إبرام أي اتفاق يقيد من سيادتها هو جزء من سيادتها. إذ وطبقًا لبعض هذه النظريات فإن الاتفاقيات الدولية التي تنص على التدخل لا يمكن اعتبارها باطلة في ظل القانون الدولي طالما أن غرضها مشروع وأن إرادة الدولة المتعاقدة ليست مشوبة بعيب الإكراه. وتطبيقًا لذلك فإن المادة 4(ح) من القانون التأسيسي للاتحاد الإفريقي تضع على عاتق الدول الأطراف التزامًا بقبول أي تدخل من جانب الاتحاد في ظل الظروف الخطيرة الواردة فيها (جرائم الحرب والإبادة الجماعية والجرائم ضد الإنسانية) والتي تعتبر نصًامن نصوص اتفاقية دولية، فالدول الإفريقية بمصادقتها على القانون التأسيسي للاتحاد قد ألزمت نفسها بنصوص هذه الاتفاقية بما فيها المادة 4(ح)، التي منحت للاتحاد حق التدخل في ظل الظروف الخطيرة الواردة فيه.
International law has long recognised the principle of sovereignty that allows states to conclude agreements that limit their sovereign power .in addition, the conclusion of such agreements is regarded as an attribute of their sovereignty, and therefore as affirmed by some theories are not void but valid, as far as their object is legitimate and their consent to be bound by a treaty may not be procured by coercion. As regards article 4(h) of the AU's constitutive act, states parties have agreed in advance to comply with it. this means that these states are under obligation to accept any AU's intervention in their territories in grave circumstances, namely war crimes, genocide, and crimes against humanity. after ratifying the AU's contitutive act, african states are to be bound by the provisions of this treaty including article 4(h) which has codified the right to intervene.

يهدف البحث إلى قياس تأثير ادارة التسويق في تطوير المنظمة. وقد تجسدت مشكلة الدراسة في حاجة شركة مملكة بغداد / لتوزيع المنتجات الغذائية إلى الادارة التسويقية في زمن التكنولوجيا الحديثة من اجل التعامل مع الاسواق المتنوعة التي تهدف الشركة الى تسويق منتجاتها لها ، وخاصة في مجال الالبان والعمل على سد حاجة السوق من خلال توفير منتجات الالبان فيها مما يعود بالنتائج التسويقية الايجابية للشركة في تحقيق اهدافها والذي بدوره يؤدي الى تطويرها ودخولها في اسواق جديدة .
طبقت الدراسة في شركة مملكة بغداد / لتوزيع المنتجات الغذائية / بغداد ، لاجراء الجانب العملي من الدراسة ، ووقع الاختيار على موظفي الشركة مجتمعا وعينة للدراسة والبالغ عددهم (61) فرداً ، على وفق استبانة اعدت لهذا الغرض ضمن متغيرين ( ادارة التسويق في زمن التكنولوجيا الحديث وتطوير المنظمات )، تضمن المتغير المستقل ادارة التسويق الابعاد ( تسويق العلاقات ، الاتصال ، المعلومات ، الوسائل التقنية) واشتمل المتغير المعتمد تطوير المنظمات على الابعاد ( الافراد ، التدريب ، ادارة الجودة الشاملة) .
اعتمد المنهج الوصفي التحليلي منهجاً للدراسة وجرى اختبار عدد من الفرضيات باستخدام عدد من الاساليب الاحصائية الوصفية والتحليلية باستخدام البرنامج الاحصائي الجاهز (SPSS.V.24).
أكدت النتائج وجود علاقة ارتباط وتأثير بين ادارة التسويق وتطوير المنظمات .
يعتبر الفساد من الظواهر التي عرفتها المجتمعات المغاربية، والتي أخذت أبعاداً واسعة في الآونة الأخيرة، وهذا نتيجة عدة عوامل سياسية وإقتصادية وإجتماعية، مشكلة- أي ظاهرة الفساد- خطرا يهدد هذه الدول التي أدركت ضرورة التصدي للفساد من خلال إيجاد مجموعة من الآليات الوقائية والعقابية التي تواجه بها هذه الظاهرة وتحد بذلك من حدة خطرها.
Corruption is one of the phenomena known to Maghreb countries and which has grown in recent times, due to several political, economic and social factors: - the phenomenon of corruption- threatens those countries that have understood the need to fight against corruption by creating a whole series of preventive and punitive mechanisms and thus limit the gravity of the danger
