This research is a comparative study between Islamic Sharia and Algerian law with regard to the of Notarial contracts and how to formulate a gift contract for example, so its purpose was to show the close link between Islamic jurisprudence and Algerian law governing the Notarial profession adopted by the public writer in writing the various contracts that people deal with And I relied on that on the method of comparison, and I clarified the points of agreement and the difference between them, and I concluded that the documents that notaries deal in their offices do not differ in the sentence from the documents mentioned by Islamic Sharia scholars in the books of documents and rulings. I dealt with sides or aspects of this issa, one is the article which is the meaning of the juristic trend in interpretation, its emergence and its important publications. And it was the fortune of the Maliki school. I also showed the main reason of the difference between the interpreters when interpreting the verses of provisions and the effect of the origins of the doctrine on the difference. Then i went through of the most prominent verses of provisions which contain a lot of disagreement amoug a group of interpreters belonging to different doctrines and i followed their choices . To sum up at the end that the juristic background had a great impact on the interpretation of the verses of provisions since the same verse may be used the four doctrines even if they have an antibody difference. However some of them were bigoted and constrain themselves to infer with the verse even though it doesn't fit.Whereas some others are moderate in their inference. The particularity of Malek Bennabi comes from the difficulty of classifying him among the serious projects whose only concern was the advancement of the Arab and Islamic nation so that it regains its place among civilized nations. He is an eminent thinker who drew on Western heritage and lived Western civilization in all its negative aspects, consisting of its colonization of peoples; and positive represented by what it presented to its people and to the world regarding undeniable civilizational achievements. But at the same time, he remained faithful to his Islamic intellectual training which marked his whole project of renaissance : the aim remains to systematically invent new precisely intercultural communication systems guaranteeing the perpetual cohabitation of civilizations and even cultures. This brief presentation of the importance of Malek Bennabi among the currents of social reform tries to evaluate his intellectual production with a critical and objective approach in order to shed light on his thought and give a brief overview of his intellectual traininh and his position vis- vis-à-vis the Arab-Islamic renaissance projects La particularité de Malek Bennabi provient de la difficulté de le classer parmi les projets sérieux dont la seule préoccupation était l'avancement de la nation arabe et islamique pour qu'elle retrouve sa place parmi les nations civilisées. Il est un éminent penseur qui a puisé dans l’héritage occidental en vécu la civilisation occidentale dans tous ses aspects, négatifs, consistant en sa colonisation des peuples ; et positifs représentés par ce qu’elle a donné à ses peuples et au monde concernant les réalisations civilisationnelles indéniables.
