الإنترنت هو وسيلة عالمية بامتياز، توفر الوصول إلى المعلومات، وتسهل الاتصالات، ولكنها كذلك منفذا للولوج إلى محتويات غير ملائمة وضارة. فالمواد الإباحية التي تستعمل الأطفال لم تصبح صناعة مربحة فحسب، بل أدت أيضًا إلى الاستغلال والاعتداء الجنسيين على القصر، وتعريضهم إلى مشاهدة مضامين إباحية تضر بنموهم النفسي. وعليه، يمكن اثارة إشكالية تحقيق توازن بين عدة مصالح: حقوق الخصوصية، وحرية التعبير من جهة، وحماية الأطفال وحقوقهم من جهة أخرى. يتناول هذا المقال طبيعة الجرائم الجنسية التي يتعرض لها الأطفال عند تصفحهم للانترنت، وعرض مختلف التدابير التي طبقت في الجزائر، ودول أخرى من اجل حماية الأطفال على شبكة الإنترنت. ليتم مناقشة الخيارات المطروحة للتعامل مع هذه المشكلة، إذ يبدو أنه من الضروري تنفيذ مجموعة من التدابير، بما فيها القانونية، وأخرى تقنية. وقد توصلنا من خلال هذا المقال إلى عدة نتائج منها: ضرورة تحسيس الجمهور و خاصة الأولياء والتلاميذ من مخاطر الانترنت وتكوينهم في كيفيات استعماله، وكذا تعزيز التحكم في نشر المعلومات الشخصية عن الأطفال على الانترنت وتكوين المحققين والقضاة حول تقنيات، وإجراءات البحث عن الجرائم على الانترنت.
The Internet is a global medium par excellence, providing access to information and facilitating communication, but it is also an access to inappropriate and harmful content. Child pornography has not only become a lucrative industry, but has also led to sexual exploitation and abuse of minors, exposing them to viewing pornographic content that harms their psychological development. It is therefore problematic to strike a balance between several interests: the right to privacy, freedom of expression and the protection of children and their rights. This article examines the nature of sexual offenses that children are exposed to when surfing the Internet and reviews the various measures that have been taken in Algeria and other countries to protect children on the Internet. The options for resolving this problem are discussed, as it seems necessary to implement a series of measures, including legal and technical measures. We have achieved several results through this article, including: the need to raise awareness among the public, in particular parents and students, of the dangers of the Internet and their training in the means of its use, as well as to strengthen the monitoring of the dissemination of personal information about children on the Internet and the training of investigators and judges on techniques and procedures for searching for offenses on the Internet.
