تكمن خطورة فيروس كورونا في سهولة انتقاله بشكل يضاعف مخاطر الإصابة بالتهابات حادة في جهاز التنفس، هذا الوباء الذي ضرب العالم استدعى اتخاذ إجراءات أولية أغلبها في غياب أي غطاء قانوني فالتخوف والارتباك الذي مس العالم نتيجة الانتشار السريع لهذا الوباء، جعلت السلطة السياسية في الجزائر تعلن إجراء الحجر الصحي، وما تبعه من إعلان لحالة الطوارئ الصحية.
  إن حالة الطوارئ الصحية لا تدخل ضمن الحالات المشار إليها والتي تضمنتها نصوص الدستور الجزائري وأهم الشروط  المطلوبة لإعلانها ،أي أنها غير مقننة في الدستور، وهي أقل من حالة الحصار أو حالة الطوارئ أو الحالة الاستثنائية، ولكن تلتقي هذه التدابير جميعها في كون الإجراءات المتخذة في نطاقها من طرف السلطات المختصة، من شأنها المساس بالحريات والحقوق المدنية والسياسية للأفراد نتيجة توسيع صلاحيات بعض السلطات الأمنية أو العسكرية، بهدف إرجاع الأوضاع إلى حالها الطبيعي وحفظ النظام العام ولو استدعى ذلك المساس ببعض الحقوق والحريات المقررة في الدستور للأفراد.
