تعد السنة النبوية الشريفة المصدر الثاني للتشريع بعد القرآن الكريم، فهي من الأدلة الشرعية المتفق عليها بين المذاهب الإسلامية المعتبرة. وكونها الدليل الثاني بعد القرآن الكريم جعل علماء الأصول يهتمون بدراسة جوانب من السنة، وذلك لتعلقها بالتشريع، فكانت نقطة التقاء بين المحدثين والأصوليين، وقد عني كلا الفريقين بتحديد بعض المفاهيم التي تتعلق بمباحث السنة. وعلم مصطلح الحديث وعلم أصول الفقه علمان أبدعت فيهما الأمة الإسلامية أيما إبداع، فتميزت بهما هذه الأمة عن سائر الأمم. وفي هذين العلمين من القواعد والتأصيل ما بهما تضبط أصول الرواية وأصول الاستدلال؛ أصول الرواية يختص بها علم الحديث، وأصول الاستدلال يختص بها علم أصول الفقه. وموضوع هذا البحث يعنى ببيان تعريف السنة عند الأصوليين والمحدثين، وبيان نقاط التوافق والتباين بينهما، وبيان سبب الاختلاف الحاصل في تعريفها. كما يعنى أيضا ببيان منزلة السنة في الاحتجاج بها عند كلٍ من الأصوليين والمحدثين، وذلك بعرض أقوال الفريقين في مجال الاحتجاج بالسنة.
Sunnah is the second source of legislation after the Holy Quran, it is one of the accepted legal evidence between prevalent Islamic doctrines. Which leads Muslim scholars to be interested in studying the aspects of Suunah. It is a point of convergence between Muhadithines and Ussolists. The science of Mostaleh hadith and the science of Oussul Fiqh are two sciences in which the Islamic nation excelled, and by them this nation was distinguished from all other nations. In these two sciences, there are rules that govern the principles of storytelling and the principles of inference; the principles of storytelling are specialized in the science of Hadith, and the principles of inference are specialized in the science of Ousul Fiqh. The theme of this research is to clarify the definition of Sunnah according to Ussolists and Mohadithines; clarify the points of compatibility and contrast between them, and explain the reason for the difference in its definition. It is also a question of clarifying the statute of the Sunnah by invoking it as much with the Ussolists as with Mohadithines, by presenting the statment of the two parties in the field of the invocation of the Sunnah.
