يُعَدُّ خيار الرجوع في عقد البيع الالكتروني خياراً أقره المشرع في بعض القوانين التي تخص المستهلك ضماناً له من مغبة التسرع وعدم التفكير والتروي ، وهو يقدم على إبرام عقوده على السلع والخدمات ، دون التفحص والتمعن في مدى ملاءمة هذه السلع والخدمات لرغباته واحتياجاته، فيكون للمستهلك (المشتري) من خلالها الخيار الحق في فسخ العقد أو إمضائه خلال مدة زمنية محددة بنص القانون، وتُعَدّ من القواعد المتعلقة بالنظام العام التي لا يجوز الاتفاق على مخالفتها ، حمايةً للطرف الضعيف (المستهلك) من ممارسات البائع المحترف الذي يستخدم وسائل الضغط والإغراء من خلال الدعايات والإعلانات ، مما يغري الطرف الضعيف المستهلك(المشتري) من الإقدام على إبرام العقد دون تفكير وتروي ، وتبرز اثناء إستعمل خيار الرجوع بعض المشاكل العملية ، فضلاً عن إختلاف الآثار التي تترتب على طرفي العقد قبل وبعد إعمال خيار الرجوع في عقد البيع الالكتروني.
دفت هذه الدراسة إلى تقييم مواقع إنشاء بعض المدارس الابتدائية والكشف عن علاقته بالسلوك العدواني لدى طفل القسم التحضيري، ودراسة الفروق بينهم في مستوى هذا السلوك تبعا لتقييم لمتغير الجنس، ولتحقيق ذلك تم تطبيق الدراسة على عينة من أطفال التحضيري بلغت 80 طفلا وطفلة. ولغرض جمع بيانات الدراسة تم بناء شبكة ملاحظة لقياس السلوك العدواني الذي يبديه الطفل وتكييف مقياس لتقييم موقع المدارس، وباستخدام معامل الارتباط "سبيرمان للرتب" واختبار "ت" لدراسة الفروق بين متوسطين غير مرتبطين ولعينتين غير متساويتين توصلنا إلى النتائج التالية: وجود علاقة عكسية دالة إحصائيا بين التقييم الموقعي للمدرسة والسلوك العدواني لدى طفل القسم التحضيري، عدم وجود فروق ذات دلالة إحصائيا في درجات السلوك العدواني بين الجنسين. وخلصت الدراسة إلى جملة من الاقتراحات أهمها: محاربة التفكير التقليدي في إنشاء المدارس والذي يقوم على الفصل بين المعطى الفني ـــ التقني والمعطى البيداغوجي في عملية تصميم وإنشاء هذه المباني، مساهمة المختصين في مجالي التربية والتعليم في عملية اتخاذ قرار اختيار موقع البناء المدرسي وإبداء رأيهم حول بعض المعايير والمواصفات المساعدة على عمليتي التعليم والتعلم ذات العلاقة بالبناء المدرسي والفضاءات التي يوفرها، توفير الملاعب الرياضية المجهزة بما يناسب مستخدميها من التلاميذ؛ بغرض إتاحة الفضاء الضروري لإحساس الطفل بحريته.
This study aimed to evaluate the locations of selected primary schools and their relationship to the aggressive behavior of the pre-school child, and to study the differences between them by assessing the gender variable. For this purpose, the study was applied to a sample of 80 children and girls in the preparatory class. For the purpose of collecting data for the study, an observation grid was constructed to measure the child's aggressive behavior and adapt a scale to assess the location of schools. Using the "Spearman for Ranks" correlation coefficient and the "T" test to study the differences between two unrelated averages and two unequal samples, we achieved the following results: The presence of a statistically significant inverse relationship between the assessment on school location and the aggressive behavior of the child in the preparatory class; There are no statistically significant differences in the levels of aggressive behavior between the two sexes; In the end, this research is concluded with a set of proposals, the most important of which are the following: fighting against traditional thinking in the creation of schools, which is based on the separation of artistic-technical and pedagogical facts in the process of designing and constructing these buildings; The participation of specialists in education’s fields and teaching in the decision-making process for the choice of location of the school building and to give their opinion on certain standards and specifications helping in the teaching and learning process related to the school building and the spaces it offers; To provide equipped sports fields that are suitable for student users, in order to provide the necessary space for the development of the child.
