يتناول هذا البحث ((منهج الإمام الشنشوري الفقهي في الفرائض))، من حيث ذكر سيرة الإمام الشنشوري، وكذلك بيان منهجه العام في التأليف، ثم ملامح منهجه الفقهي في الفرائض، وذلك بذكر مصادره الفقهية التي يعتمد عليها وكيفية الإحالة إليها والاستفادة منها، وكذلك عرضه للمصادر التشريعية من قرآن وسنة وإجماع وقياس وأقوال الصحابة رضي الله عنهم، وكيفية الاستدلال بها والترجيح بينها، ثم بيان منهجه في عرض المذاهب الفقهية والترجيح بينها، وقد خلصت الدراسة إلى أن الإمام الشنشوري كان إمام الفرائض في زمانه وقد كان صاحب علم واسع في الفرائض وغيرها من علوم الشريعة، وأن كتبه من أهم المراجع المعتمدة في الفرائض وخاصة كتاب ((فتح القريب المجيب))، وهو صاحب معرفة واسعة بالمذاهب الفقهية، و قد التزم أصول المذهب الشافعي في مؤلفاته الفرضية، وأما ترجيحاته الفقهية فقد كان يعتمد على فروع المذهب الشافعي، وقد كان صاحب أمانة علمية وتوثيق سليم، وكذلك كان صاحب أدب علمي رفيع وخلق فاضل في تعامله مع المخالفين
This research deals with ((manhaj al'imam Al-Shinshuri alfeqhe fi alfaraydh)), In terms ofmentioning the biography of Imam Al-Shanchuri, as well as explaining his general approachto authorship, and then the features of his jurisprudential approach to obligations, bymentioning his jurisprudential sources on which he relies and how to refer to and benefit fromthem. As well as his presentation of the legislative sources from the Qur’an, Sunnah,consensus, measurement and the sayings of the Companions, may God be pleased with them,and how to infer them and weight them, then explain his method in presenting thejurisprudential schools and the weighting between them.In end the study concluded that Imam Al-Shanchuri was the imam of the obligatory dutiesof his time and he was the author of a wide knowledge in the obligatory duties and othersciences of Sharia, and that his books are one of the most important references approved inthe obligatory science, especially the book (Fath Al-Qareb Al-Mujeeb), and he has extensiveknowledge of jurisprudence schools, and he adhered to the fundamentals of the Shafi'i schoolin his obligatory writings, and as for its jurisprudential preferences, he was based on thebranches of the Shafi'i school of thought, and he was the owner of scientific trust and rightdocumentation, as well as the owner of a high scientific literature and virtuous manners in hisdealings with the violators.
