هدفت الدراسة الى تَتَبُّعَ آراءِ الخَفَاجِيِّ حَوْلَ الألفاظِ والمعانِي. قضيَّةُ اللفظِ والمَعْنَى مِنَ القَضَايَا المهمَّةِ الَّتِي وَقَفَ عِنْدَهَا العلماءُ يُبَيِّنُونَ آراءَهُمْ حَوْلَهَا، وَقَدْ كَانَ الخَفَاجِيُّ مِمَّنْ وَقَفَ إِزَاءَ هَذِهِ القضيّةِ وَرَاحَ يتحدَّثُ عَنْهَا فِي كتابِهِ. وَقَدْ فَرَّقَ بَيْنَ الفصاحَةِ والبلاغَةِ وَوَضَعَ لَهَا شروطًا وأقسامًا. تَوَصَّلَتِ البَاحِثَةُ إِلَى أَنَّ الخَفَاجِيَّ قَدْ شُغِلَ بالمَحَاسِنِ والعُيُوبِ للألفاظِ والمَعَانِي وَفِي تَقْسِيمَاتِهِمَا الكَثِيرَةِ متأثرًا بقُدَامَةَ بْنِ جَعْفَرٍ، وَقَدْ كَانَ لابْنِ سِنَانٍ الخَفَاجِيِّ جُهْدُهُ البَلَاغِيُّ والنَّقْدِيُّ فَبَيَّنَ قِيمَةَ الألفَاظِ المُفْرَدَةِ والألفَاظِ المُرَكَّبَةِ وَبَحَثَ خَصَائِصَهَا الصَّوْتِيَّةَ وَمَا يَعْتَرِيهَا مِنَ العِلَلِ والمُحَسِّنَات وَكَذَلِكَ فَعَلَ فِي المَعَانِي.
خلّف الاعتداء الفرنسي على أرض الجزائر -والذي جابهته الثورة التحريرية الجزائرية بكل عزم وحزم- ملايين الشهداء والمعطوبين، كما خلف ذوي الحقوق والمجاهدين، وقد أقر المشرع الجزائري لهم بتعويضات قانونية؛ تتمثل في منح وامتيازات مادية ومعنوية، قصد حماية هذه الفئة ماديا ومعنويا والوصول إلى أفضل الصيغ القانونية في تعويضهم، لذا جاء هذا البحث لتأصيل مشروعية تعويض ذوي الحقوق في الشريعة الإسلامية مقارنة بما جاء في القانون.
After The Algerian liberation revolution a wide group of mujahideen, martyrs, and rights holders has been left.
The Algerian legislator decided that these groups have compensations represented in grants and privileges.
The main problem that presents this study is how extent of the legality of these compensations in islamic law, and the legality of transfering them to the heirs?
