تبحثُ هذه الورقات مسألة من المسائل الفِقهيَّة الـمُهِمَّة، التي اختلف في بيان حُكمها العُلماء، وخاض غِمارها بعضُ العوام والدَّهماء؛ وهي مسألة:" غرس الجريد والرَّيحان والزُّهور ونحوها من النَّبات الرَّطب على القبور "؛ فجاءت هذه الدِّراسة لتُبَيِّنَ أقوال العُلماء في القديم والحديث فيها، وتجلِّي الأدلَّة النَّقليَّة والعقليَّة التي عوَّلوا عليها، ثمَّ تكشف عن قائمة المدافعات الواردة على هاذيك الاستدلالات؛ للخُلوص إلى القول الرَّاجح في المسألة، بحسب ما يفضي إليه الحديثُ والأثر، ويجرُّ إليه جانبُ التَّعليل والنَّظر. وتتنزَّل هذه الورقة البحثيَّة ضِمن سعي جديد، وطرح سَعيد؛ في الدَّعوة إلى انصاف المذاهب الفِقهيَّة المتبوعة، والتَّخفيف من التَّعصُّب المذموم لاجتهادات الأشخاص، كما ترمي هذه السُّطور إلى الدُّربة والمِران على صناعة العقل الفِقهيّ الجسور، وتكوين الـمَلَكة الفِقهيَّة الـمُتَضَلِّعة، والتي لا تتَحقَّق إلاَّ من خِلال الاستشراف على أقوال الأيمَّة الفحول.
These papers examine one of the important jurisprudential issues, which scholars differed in stating their rulings, and some commoners and demagogues fought over it. It is an issue: “Planting leaves, basil, flowers and the like on the graves of wet plants.” This study came to clarify the sayings of scholars in the ancient and modern times about them, and the transmission and rational evidence that they relied on, and then reveals the list of defenses contained in these inferences; To conclude the most correct opinion on the issue, according to what the hadith and effect lead to, and the aspect of reasoning and consideration is drawn to it.This research paper is included in a new endeavor, and Said's proposal; In the call for the fairness of the followed jurisprudential schools, and to reduce the blameworthy fanaticism of people’s jurisprudence, as these lines aim at training and training in themanufacture of the wise jurisprudential mind, and the formation of the faculty of jurisprudence, which is only foresight on the wise sayings.
