تُعتبر هذه المقالة بحثاً علمياً أكاديمياً، وهي في واحدة من أهمِّ مسائل علم أصول الفقه، يطرح فيها الباحث إشكاليةً أصوليةً، تتمثَّل في معرفة دلالة ما همَّ به النَّبيِّ صلى الله عليه وسلم ولم يفعله. سلك الباحث فيها المنهج الاستقرائي التحليل، وذلك من خلال تعريف همِّ النَّبيِّ صلى الله عليه وسلم، مسبوقاً بالتعريف اللُّغوي والاصطلاحي للهمِّ، ثمَّ ذكر أنواع ما همَّ به النَّبيُّ صلى الله عليه وسلم، وتقسيم ما همَّ به صلى الله عليه وسلم إلى عدَّة أقسام؛ وذلك حسب ثلاث اعتبارات؛ الاعتبار الأوَّل: من حيث الفعلُ والترك،والاعتبار الثَّاني: من حيث اللَّفظُ الدالُّ على همِّ النَّبيِّ صلى الله عليه وسلم بالشيء، وأمَّا الاعتبار الثالث: فمن حيث وجود أو انعدام المانع لتحقيق ما همَّ به النَّبيُّ صلى الله عليه وسلم، مع ضرب الأمثلة على كلِّ نوع، ومِنْ ثَمَّ ذكر أقوال الأصوليين في حكم ما همَّ به النَّبيُّ صلى الله عليه وسلم، وإيراد أدلتهم التي استندوا إليها، وصولاً إلى مناقشة تلك الاستدلالات، ومحاولة الجمع والترجيح بينها. وقد جعل الباحث مقالته في مطالب ثلاثة.
This essay is an academic research on one of the main issues in the knowledge of jurisprudence principles. The issue of knowing the indication of the prophetʼs intention to do something but not doing it. The researcher has adopted an approach of inducing information in his analysis, by defining what is meant by the prophetʼs intention of doing something and prior to that mentioning the lingual and conventional definition of “intention” then mentioning the types of the prophetʼs intentions and dividing them into different groups. This is by taking three points into consideration, which are, First: According to his action or non action, The second: According to the words that indicate his intention to do something. As for the third consideration it is the existence or non existence of what prevented the prophet peace be upon him from doing what he intended to do. Also providing examples for each type, then mentioning the sayings of jurisprudence principles scholars on the ruling concerning the prophetʼs intention to do something that he didnʼt do and the evidence they rely on. Then debating the evidence and trying to join their evidence and weigh it.
