حسب قوانين الطبيعة؛ فان كل شيء يتشكل من مجموعة عناصر ومكونات تشكل قوامه واساس نشؤه فالشي يساوي حاصل جمع عناصر ومواد يتشكل منها، هذه القاعدة تجد لها حضوراً في مادة بحثنا التي تتمحور حول تطبيق المحكم للمبادئ العامة للقانون. فهذه المبادئ يمكن أن توصف بانها المواد الاولية الخام التي صنعت منها القواعد القانونية فالأولى تدخل في تكوين الثانية وتحتاج لصانع لها؛ إلا وهو المشرع، ويمكن أن تتطور فيما بعد تلك المبادئ من خلال القضاء أو التحكيم، فهـي معـين لا ينضـب، يلجـأ إليهـا كل من المحكم والقاضي؛ عنـد الحاجـة، اذ انها تتسم بطابع العمومية المستمد من الاعتراف بها من جانب التشريعات الوطنية لمعظم الدول مهما كانت طبيعة النظام القانوني الذي تنتمي إليه، ومن ناحية أخرى تتميز بأنها مبادئ أساسية كونها تهيمن على مجموعة من القواعد التفصيلية التي تتفرع منها.

إن التراث العمراني هو المجال المدني الذي يميزنا و يعبر عن شخصيتنا ، و هو بهذا مرتبط بالهوية الوطنية و بالشخصية الاجتماعية و المظهر الجمالي البصري للبيئة المحلية و مع ذلك فنحن هنا لم نتطرق إلى عمر المبنى و نوعه ، لأن التراث العمراني يمكن أن يكون قريبا جدا من الناحية الزمنية ، و يمكن أن يكون غائرا في التاريخ ، لكنه ما زال له أثر واضح في الفضاء الاجتماعي و الثقافي المعاصر ، لأن التراث العمراني مرتبط بالحياة المعيشية ، أي انه عمران حي يحمل إرثا تاريخيا عميقا متراكم عبر الزمن (ملتقى التراث العمراني2011 ، ص 10) خاصة فيما يتعلق بالحلول البيئية المنتهجة على مستواه ، حيث أنه و في هذا الإطار حاولت العديد من الدراسات الاستفادة من التجارب البيئية المعاصرة خاصتا منها الغربية دون أخذ الهوية الفكرية و الثقافية لمجتمعاتنا المحلية ، في حين ناقشت دراسات أخرى موضوع التراث العمراني بأسلوب تاريخي ، و هو شيء مطلوب ، و لكن خصائص التفكير في جوانب التراث العمراني من منظور بيئي معاصر تحتاج إلى الاهتمام بها بشكل أكبر. 

Urban Heritage Is the civil domain which distinguishes us and expresses our personality , It is thus linked to national identity , social personality and visual aesthetics of the local environment , However ; We did not address the age of the building and its type , because urban heritage can be very close in time , and it can be very old historically , but it still has a clear impact on contemporary social and cultural space , because urban heritage is linked to living life , That is, he is alive and carries a deep historical legacy accumulated over time especially the environmental solutions used in it , In this context, many studies have attempted to benefit from contemporary environmental experiments, especially Western ones, without taking the intellectual and cultural identity of our local communities. While other studies discussed the subject of urban heritage in a historical way, which is required , But the study of urban heritage aspects from a contemporary environmental perspective needs to be given more attention
