إن قانون الجرائم والعقوبات اليمني قسم جرائم الاعتداء على ملك الغير إلى ثلاث جرائم وهي جريمة الإضرار بالمال، وجريمة  الإخلال في الثقة في بيع العقارات، وجريمة نقل وإزالة الحدود، وهذه الدراسة ستقتصر حول جريمة الإضرار بالمال المعاقب عليها وفقًا للقانون. وتعتبر ظاهرة التعدي على أموال الغير بالإضرار بها من الظواهر الأكثر انتشارًا في اليمن، وهذا ما أكده التعميم الصادر عن مكتب النائب العام برقم (١٣) لسنة ٢٠٢٠م بشأن المتهمين في قضايا التعدي على ملك الغير، الذي صدر لمواجهة هذه الظاهرة ومواجهة مرتكبيها بحزم بعد أن لوحظ من احصائية النيابة العامة للعام القضائي ١٤٤١هـ ارتفاع معدل جرائم التعدي على ملك الغير، وذلك من خلال تقدير الأدلة التي تكفي سندًا لاتخاذ أعضاء النيابة العامة لقراراتهم بالحبس الاحتياطي لمرتكبي هذه الجريمة، ومتابعة إجراءات التحقيق في هذه القضايا أولًا بأول. وأن المتعين على أعضاء النيابة العامة عدم الإفراج عن المتهمين وإحالتهم للمحكمة محبوسين في حال كفاية الأدلة التي ترجح الإدانة. حيث وجه كافة أعضاء النيابة العامة ووكلاء ورؤساء النيابات التقيد بهذا التعميم وتنفيذه بكل دقة. كما وجه التفتيش القضائي في النيابة العامة بالمتابعة والرفع بما يُفيد التقيد بما ورد في هذا التعميم.

لعب عدة مجالات و مرافق و فضاءات داخل البيئة الحضرية التي تساعد الطفل على تلبية حاجاته الاساسية المتعلقة بمختلف الجوانب النمائية و تحقيق التوازن الانفعالي و تنشيط علاقاته الاجتماعية لضمان النمو السليم له من الناحية النفسية و العقلية ،الجسدية و الحسية ،ورغم أهميته هذه الفضاءات الا أنها لم تأخذ مكانها على أرضية الواقع داخل البيئة الحضرية . لذلك نحاول من خلال هذه الورقة البحثية التأكيد على ضرورة توفير فضاءات لعب ذات معايير عالمية و ضوابط تضمن جودتها و نوعيتها و تتناسب مع متطلبات الطفل و إدراجها ضمن التصميم العمراني للمدن نظرا لما تلعبه من دور أساسي في الحفاظ على صحة الطفل و تنمية شخصيته على كافة المستويات . الكلمات المفتاحية :الفضاءات ،اللعب ،البيئة الحضرية

Play has several areas, facilities and spaces within the urban environment that help the child to meet his basic needs related to various developmental aspects and achieve emotional balance as well as stimulating social relations to ensure his proper growth from psychological, mental, physical and sensory aspects. Despite the importance of these spaces, they didn’t take their place on the ground in the urban environment, therefore, we are trying through this research paper to focus on the necessity of providing play spaces with international standards and controls that ensure their quality and fit the child’s needs, in addition to including them in the city’s urban design due to its crucial role in maintaining the child's health and developing his personality at all levels.
