تعتبر مباحث الأمر والنهي الأصولية من أهم الموضوعات المطروقة في علم أصول الفقه في هذا العصر حيث أُلِّفت فيها رسائل علمية، وبحوث عديدة، شملت جانبيها التأصيلي والتطبيقي، وموضوع هذا البحث يتعلق بالجانب التأصيلي لأهم المباحث الأصولية بين شرح المنهاج للأصفهاني وشرح مختصر الروضة للطوفي في باب الأمر والنهي  حيث تناولت محاوره: التعريف بالمؤلفين الطوفي والاصفهاني، وقد قسمت البحث إلى مقدمة اشتملت على أهمية الموضوع وأسباب اختياره وإشكاليته وأهدافه, ثم مبحث تمهيدي تطرقت فيه عن تعريف أصول الفقه ثم حياة المؤلفيّن الطوفي والأصفهاني رحمهما الله تعالى، ثم جاء الفصل الأول متناولاً موضوع الأمر إذ قمت بدراسة مفهوم الأمر وحقيقته عند الطوفي والاصفهاني وبعدها بينت صيغ الأمر ومقتضاه  عند الطوفي والاصفهاني، وأخيراً خصصت مبحث لدراسة الأمر بعد الحظر عند الطوفي والاصفهاني.
ثم جاء الفصل الثاني متناولاً النهي إذ قمت بدراسة مفهوم النهي وحقيقته عند الطوفي والاصفهاني وبعدها بينت صيغ النهي ومقتضاه  عند الطوفي والاصفهاني.

يهدف البحث إلى الوقوف عند معالم الخطر المهدد لصحة وأخلاق الطفل مع بيان طريقة تعامل المنظومة التشريعية الجزائرية في مواجهته في سبيل ضمان حماية الطفل ودفع الخطر عنه.
وقد حصر تلك المعالم في: التدخين، المشروبات الكحولية، المخدرات والمؤثرات العقلية، حيث تم التوصل إلى أنه رغم الجهود المبذولة من الدولة لضمان حماية الأطفال إلا أنها ليست كفيلة بتحقيق الهدف المنشود على اعتبار التزايد المستمر في تعرض الأطفال لتلك المعالم خاصة مع ظهور المخدرات الرقمية، وعجز القانون عن تنظيمها هذا ما يستدعي التفعيل الحقيقي لدور المجتمع المدني من أجل الحفاظ على صحة الطفل وأخلاقه

The present research aims to identify the risks profiles that threat the children's health and morals , and indicate how the Algerian legislative system deals with it ; in order to ensure the child protection and fending off the threat .
These profiles have restricted to: smoking, alcohol, drug, and psychotropic substances , where it was reached that although the state's efforts to ensure the child protection; they aren't enough to achieve the desired goals ; considering the ever-increasing in children's exposure to these profiles, especially with the appearance of the digital drugs , and the law's enability to regulate them .
So that's call for a real activation of the civil society role , in order to maintain the child's health and morals .
