تفعيل آليات الاستثمار الوقفي في الجزائر بين النصوص القانونية و الممارسات الميدانية

تعد عملية الاستثمار الوقفي محصلة لعدة مراحل عرفتها الأملاك الوقفية ابتداء من حصرها والبحث عنها واسترجاعها إلى غاية تسوية وضعيتها القانونية بإعداد سندات رسمية لها، ومن خلال تعديل قانون الأوقاف رقم 91/10 بموجب القانون رقم 01/07 المؤرخ في 22 ماي 2001، فقد فتح المجال لتنمية واستثمار الأملاك الوقفية سواء بتمويل ذاتي، أو بتمويل وطني عن طريق تحويل الأموال المجمعة إلى استثمارات منتجة باستعمال مختلف أساليب التوظيف الحديثة.
وتطبيقا كذلك لنصوص القانون رقم 01/07 المعدل لقانون الأوقاف، فقد حدد المشرع الجزائري طرق استغلال واستثمار وتنمية الأملاك الوقفية بعدة صیغ مختلفة منها عقد المقایضة وعقد الإیجار الذي یمثل أكثر العقود المعتمدة على أرض الواقع، إلى جانب عقود أخرى كعقد المزارعة وعقد المساقاة في جانب الاستثمار الفلاحي، أما فیما یخص الأملاك الوقفیة المبنیة أو القابلة للبناء فقد اعتمد على عقد المرصد الذي یعني استئجار الأرض غیر قابلة للاستئجار، إلى جانب عقد الحكر الذي هو تخصیص جزء من أرض للبناء أو الغرس لمدة معینة، وأضاف المشرع الجزائري عقد المقاولة، وعقد الترمیم و التعمیر یتم بموجبه إعادة بناء أو تصلیح للأملاك المبنیة الموقوف.

In addition to the provisions of Law No. 01/07 amending the law on endowments, the Algerian legislator has defined the means to exploit, invest and develop the Waqf properties in various forms, including the lease and the lease contract represents the largest number of contracts approved in the field, In addition to the lease, the construction of the land is not commendable, that is to say the allocation of part of the land to the construction or planting for a certain period, and the Algerian legislator has added the contract According to which the contractor is obliged to carry out work for remuneration, the contract of rehabilitation and reconstruction for the purpose of rebuilding or repairing the confiscated property .

Ce travail porte sur l'étude des propriétés de phototransport dans les semiconducteurs amorphes. Cette étude est faite par simulation numérique de la photoconductivité en régime transitoire qui repose sur les deux mécanismes de transport: le processus de multi-piégeages ('multiple trapping') des électrons à travers les états étendus et le processus de saut ('hopping') des porteurs de charges à travers les états localisés de la queue de bande de conduction. Nous avons développé un modèle sous forme d’équations de continuité en régime transitoire et qui réunit les deux mécanismes de transport de 'multiple trapping' et de saut. Ces équations ont été résolues numériquement pour calculer la photoconductivité transitoire (PCT). Les résultats obtenus de la PCT pour les basses températures dans le silicium amorphe hydrogéné a- Si:H sont en excellent accord avec les prédictions qui découlent de l’analyse de Monroe sur la thermalisation des porteurs de charges et le transport dans une distribution des états localisés de forme exponentielle. Nous avons utilisé la simulation pour étudier les contributions relatives aux deux processus de conduction par 'multiple trapping' et saut dans la PCT pour différentes densités des états des semiconducteurs désordonnés.
